disability appeal denied

    hello,i was denied disability claim previously which i appealed and which was recently denied again. i suffer from tinnitus which is mentally depressing and i also suffer some hearing loss but the tinnitus is the main problem for me on a daily basis. I wrote a heartfelt appeal letter which obviously didnt make a difference to them but i also have to keep going to seetec or else my jobseekers allowance will be cut. i never wanted to look for work since i suffer from this and its why i applied for disability allowance in the first place. id just like to know is that the end of my claim for disability now since both appeals were denied? i truly hate going to seetec and its not fair that i have to abide by their rules when all i wanted was to try to live my life as normal as possible without added pressure. id be grateful if anyone here has any sort of info as to any other steps i can take. thank you.

    A lot of the deciding factor comes down to your medical reports from your doctor, your medical consultants and audiologist reports. Did your G.P. believe that the degree of tinnitus that you have was severe enough to qualify.

    hi, my doctor wrote a letter stating that my level of tinnitus was very depressing for me and wrote on behalf of me that i didnt want to seek work because of how it affected me mentally. I posted a copy of this to the disability appeal officer and also gave a copy to my seetec advisor but it didnt make a crumb of difference. im assuming i cant even appeal anything anymore as they have already been denied and so the government wins yet again which is wrong simply because how can they assume how bad it affects me.     I am open to correction on this, but my understanding is that the condition needs to be severe enough that it prevents a person from being able to carry out any type of work duties by themselves, irrespective of the persons desire to work.
    As far as appeals go, I would go back and discuss it further with your G.P. and see what they have to say about if it prevents you from being able to work.
    In the eyes of S.W. the condition may not be severe enough that it excludes you from all types of employment as many people with tinnitus, or who are completely deaf, continue to work.

    I have an application in myself due to a severe personality disorder.
    Whether i get it or not is another decision,but it is still on mental health grounds.
    I had a report from the social worker in the local mental health dept.
    Have you reports supporting your application/appeal?
    Did they outline the reasons for refusal?
    How long were you waiting for the initial decision and then the appeal?
    Curious to know as i don't know what to expect in my own case.

    Could be down to the situation where tinnitus isn't considered a medical condition that prevents someone from been able to work ,
    Op have you anything other than Gp letter saying it's depressing you .
    Like consultants reports or ear specialist,

    Saying that you don't want to work isn't a help either

    Tinnitus isnt and shouldnt be classed as a disability.

    I suffer from it as well to varying degrees and it can be infuriating.
    I have found that using aviation grade headphones to block out all sound for a few hours can help relieve it, but it always comes back. Oddly enough, profoundly deaf people can suffer from tinnitus as well which would indicate its not a solely auditory issue.

    Hi OP
    Unless you have some more/new evidence to prove that you are not fit for work, to offer that you haven’t already shown, then there’s nothing to be gained from applying again as you’ll just get the same result.
    If I were you I would ask the GP to refer you for counseling to deal with the depressive feelings your having about the tinnitus.
    I can only imagine how annoying that permanent background noise in your head can be.
    There’s every chance that SW will be able to help you to find a job that you can do despite the tinnitus.
    Work with them because you don’t want to get cut off.

    I am 63 years old and received DA this year after 6 years and 3 appeals.

    Don't give up OP. There might be an underlying reason for your tinnitus. Mine was Meniere's disease. Try to get a diagnosis, although my main problem was vertigo attacks associated with Meniere's, your age also will influence a decision. If you are young there will be more reluctance to grant DA.

    I had actually given up applying for DA but I was summoned by Seetec and the Intreo office said that if I made another attempt for DA then Seetec would leave me alone until a decision was made. I nearly fell over backwards when DA was actually granted!

    has it been sorted with your claim?i have same situation like you hearing loss one side and tinnitus
