Hit by a drink/driving low life

    Hi all. Looking for advise. Hopefully the right sectionow.

    Long story short. I was hit last night by a drunk/drugged up scum( I could see in his eyes and reactions) he was off his face. Both cars wrote off. He tried to get back in and drive. Car was mangled so he ran. Ambulance came for me. Few marks and bumps and I was released. His mam arrived up as he ran home and told gard he is in the house (2 minutes drive away)

    So here is my issue:
    Small town, everyone knows everyone type place.

    Garda arrived, told me we "prob can't do him on drug/drink as there is a 3 hour window" but will get him on leaving scene.

    I asked gard to breathalyse and drug test me so I could be counted out but said no need as he could see I was sober.

    So call today from gardai (never asked how I was but was more concerned telling me this persons mother was in a horrible crash 3 years ago). Low and behold the late night doctor that does the blood test wasn't available until after the 3 hour Window and they let him go without being tested.

    I asked about breathalyser but said they didn't do that cause they could already smell it off him.

    Is this correct gardai procedure? I'm livid by the laziness.

    Lodge a complaint with the ombudsman and ull be public enemy no. 1 with the cops. Its ridiculous but thats the way it is.
    A mate of mine was having a boundary issue with a neibour whos a cop and checkpoints magically appeared on his boreen any morning after he went for a few pints to try to nail him for drink driving. Great use of garda resources!

    What are you talking about?

    Op make a complaint about guards not following procedure. They are obliged to take breathalysers at the scene of majors accident. If someone runs they can be arrested for leaving the scene but other procedures then fillow

    If anything is a miss the ombudsmen will find out

    So he tried driving away but car wasn't budging as it was totalled. He than ran to his house 2 mins away. Guards where there no less than an hour later. I presume a breathalyser should have been done then? And not by "smell"

    Also is this 3 hour rule thing real? Is that just for drugs?

    If not how can you be done the following morning?
