Do I have a case

    So I went for a run in co. Dublin after work on Friday, there is a road with lot of work being done on it. In particular they seem to have dug lots of holes along foot path and covered them with those raised yellow covers.

    The problem is I tripped on one of the covers while running, now I have a broken thumb on left hand, which may need surgery (to be determined with a new x-ray later in the week). Also right hand all torn up on elbow and knee but no breaks on that side.

    My question is, do i have a case for compensation from the council??

    Because you tripped over over one of the brightly colored, highly visible covers rather than an invisible hole?

    If it were faulty or the hole wasn't safely covered yes maybe but why oh why were you running/training on such terrain if you knew it was as such.

    You mentioned the covers are bright yellow and they are made like this to get ones attention....


    Very sorry to hear your in a bit of pain but jaysus suck it up and put it down to error of your judgement and move on.

    Worry about healing and do get better soon.

    Hopefully you are genuine and we don't see you in the papers in 3 years time getting €€€€s of wonga for a fall.

    In personal injury cases, solicitors retain litigation engineers on behalf of their clients. These engineers meet with the client and examine the locus of the accident in order to prepare a report which assists in relation to advising on liability.
