Payment for Public Holiday During Annual Leave

    Hi,

What happens in the event that I use one day of my annual leave entitlement on a Public Holiday?

(The Company usually pays double time on a Public Holiday).

Am I still entitled to get double pay or equivelant, when I am on annual leave.

    Thanks.

You’ll get that day back in lieu.

    Depends on the company/contract.

Public Holiday always a headwrecker. :D

So essentially I can take the day off and it doesn't come out of my annual leave entitlement, that is if the company allows it?

I must work out the maths.

So if I take a days annual leave on a PH, the company then has to pay for someone to cover me.

So person covering me gets double pay (as company policy), I get the day off too as I dont have to work and I dont have to use any Annual Leave entitltment.

Seems like an expensive day for the company (having to compensate 2 workers for PH entitlement, as opposed to one?).

Am I missing something? Maths was never my strongest subject.

    Thanks

Are you paid by the hour?

  • Thanks Wheety, yes. Paid by the hour.

According to the Organisation of Working Time Act you are entitled to 1/5 of your normal weekly pay if you don't work that day. I don't think it matters that your company pay double if you work that day. You are only entitled to an average days pay (your bonus is that you're not working it).

As you're on annual leave, you will be paid for the full week but only use 4 days leave.

  • Thanks Wheety. Thats makes sense.
