    Is the rule “ who ever puts the saw onto the timber on a public road owns it “ true?

    And who owns all the timber that’s just pushed to side of roads at moment

    My uncle took legal advice about this issue a few years ago and was told that the timber is belong to whoever’s land it’s growing on, if it is removed from the road but anyone but the land owner it’s theft. That’s what he told me anyway.

    We have the tree fairy around here.Six large branches have been blown down in the last month onto the road on land that I lease.The first that I knew about them was when I drove past and saw the remains in the hedge.All the good timber was gone.Nobody seems to know what happened.God bless the tree fairy,she saves me some hardship.

    Well around here the fella clearing the road would keep the timber if he wishes. No one could begrudge him that.

    I know this isnt your case but any landowner that bitched about timber taken off the road a few days after the fact around here would get a frosty reception. Someone who was all the timber but not willing to do the work can piss off imo. Hiding behind the fact that it's his tree is no defence if they ain't willing to clear the road in a reasonable time.

    If the council asks you to clear the road of the tree, then you could bill them,as for the owner of the fallen tree told to clear the road by the council being able to bill them for the job,thats a six million dollar question....
