    Hi all.

I have a question regarding annual leave entitlement. I was on annual leave on Monday last when storm Ophelia hit. The office was closed for the day and nobody was working.

Am I entitled to claim the day back?

I am a civil servant. My ap tells me im not entitled but I am not sure he is right

I think that if you decided before hand to take the day off then you were due off regardless. You were not going to be in that day regardless as you had something else planned so why should you get the day back?

Well for example if I was sick on annual leave I would be entitled to it back..

But I do see your point. Im just curious more than anything

I would ask a colleague who was due to be in what has been put on the clocking system to account for the day. Depending on what it is you could possibly argue it would cover someone on annual leave! (May be clutching at straws here).

If the OP was taking AL on that day for a specific reason, such as a shopping trip or a pre-booked appointment, and was unable to use their AL day as intended due to a national emergency, then I'd imagine the OP should have the credited back to them.

It's not like they could go ahead with their plans, citizens were advised by the government to stay indoors and stay safe, so my view would be annual leave could not be used as intended for health and safety reasons.

I imagine cases like this are being dealt with at a local level rather than HR level, but I'd contact your HR Unit OP to query your departments official stance on your issue.

As a civil servant, do you not have a union rep? That's where I would be going anyway.

Civil servant here as well. I had taken annual leave for Monday and Tuesday, had planned a trip from the west to Wicklow. Anyway, as the warnings were getting worse I cancelled the hotel booking on Saturday and texted my boss on Sunday explaining that I had to cancel and would go to work on Monday, that was no problem. Monday morning we all get a text saying the office is closed. Tuesday (I had planned annual leave) I attended work as normal. Anyway, just going out the door this evening we get an email from HR in Dublin saying that anyone that had planned leave will not get that day back. Pi$$ed off is an understatement. I was available and would have attended for work had the office been open.
