Bank holiday pay

    I don’t normally work Monday but my employer has asked me to work this coming bank holiday Monday, what are the rules regarding this, one fifth of my wages, double time?? I’m not sure thanks in advance

    Here’s the rules:

    Your entitlement to public holidays is set out in the Organisation of Working Time Act 1997. Most employees are entitled to paid leave on public holidays. One exception is part-time employees who have not worked for their employer at least 40 hours in total in the 5 weeks before the public holiday.

    Employees who qualify for public holiday benefit will be entitled to one of the following:

    A paid day off on the public holiday
    An additional day of annual leave
    An additional day's pay
    A paid day off within a month of the public holiday

    The Organisation of Working Time Act provides that you may ask your employer at least 21 days before a public holiday, which of the alternatives will apply. If your employer fails to respond at least 14 days before the public holiday, you are entitled to take the actual public holiday as a paid day off.

    This is useful as a reminder to mention to your employer OP. My company for example gives extra pay for working the bank holiday plus gives the day back as leave.

    I’ve had no joy with this, I didn’t get my full entitlement I’m not sure what to do!

    Yes, and so you qualify for BH pay, but not a full day's pay. If you're on close to minimum wage €30 sounds about right. I'm assuming you got full pay for the day, plus €30.

    I’m on 10.50 ph and yes usual days pay a worked the bank holiday

    I work a total of 15 hours on the books, my total weekly pay is 157.50 the bank holiday my wages were 188.05

    It’s all about how many hours you actually worked on the bank holiday. Double the hours for that day and add any other hours for the week. Multiply by your hourly rate.

    'If you do not have normal daily or weekly working hours, under SI 475/1997, an average of your day’s pay or the fifth of your weekly pay is calculated over the 13 weeks you worked before the public holiday."

    I also have a question about bank holidays. I work 33 hours a week at night, I get a basic with a shift allowance. One line of the contact reads The shift pattern is operated over 365 days a year including weekends and bank holidays. This line falls under the hours of work. Under the holidays section it states I am entitled to 21 days paid annual leave in each holiday year together with normal public/statutory holidays. The company pay double for bank holidays and triple for Christmas day. Some of us were rostered in over Christmas on the bank holidays, some were rostered off and some of us including me took annual leave as we had to take annual leave to get the day off. I did call an employment line and they said to me about the fifth of the working weeks wages to be paid. We have never received any fifth of our working week for any bank holiday that we didnt work. There is also a weekend team who work 23 hours a week , they do get the fifth paid to them. When we questioned with our manager she said "No i think it is part of your contract " that we as in the night shift are not entitled. So would anyone know based on the above lines in the contract that I shared , is this true? I would appreciate any input. Thank you
