VAT issue - Business to Business Transaction - Ebay

    I was wondering if anyone has ever encountered the below problem:

    - Irish VAT registered customer
    - Buying from a UK VAT registered seller
    - Will only deal through eBay for international sales and not their website

    I contacted them and asked them to remove the VAT element from their invoice/request for payment to us and provided our Irish VAT number.

    They claim they can't/won't do that and that the VAT issue is our problem. They also claim that eBay support this decision. I have contacted eBay about this but they are impossible to deal with (call centre with very limited knowledge/interest in the situation)

    Now we really want to deal with them (selling something few others sell) so not really an option to look elsewhere

    Has anyone ever encountered this or found a solution/documentation online that I can pass to the seller.

    I have already forwarded the relevant information to them from the HMRC website about general B2B sales between UK companies and EU companies but they say eBay doesn't count as it is a market place in the middle. I personally think this is rubbish but I can't disprove it.

    I have an appointment to talk to a HMRC VAT technician but not until next week so thought I'd ask here in case anyone might have any experience of this.

    UK -> IE wasnt really a problem before as the VAT delta was minimal but Ebays posture will have been influenced by the pressure they were put under that led to the GSP. What this does is charge VAT in advance instead of "catching" it on landing in a hit or miss fashion.

    Ebays normal listings are designed for B2C, if you want to use it in a B2B fashion you need to use the Business Supply product, or convince the seller to do so.
