I drink a lot of Coke, (to the dismay of my mother and girlfriend) I admit that.

I usually go to this petrol station near by where they sell two Cokes for two euro,

Today i went to the store to get coffee and a drink (Coke obviously) the coffee was 01:50 and the Coke was 02:50, i was surprised as the sign on the front said 'two for two', (promoting because a secondary school is literally right across the from the station) and the little signs under the Coke said 'two for two'

When i got home i checked the receipts from the last two weeks, all said for Coke 02:50, (I only realized this, because i usually pay in debit but today i forgot my debit card so i had to pay in notes)

All the signs that were saying 'two for two' have not been removed and have been up there for the last two weeks

My question is this legal, it is misleading and they are taking more money than it says

if it is can you give me a link to the Article

    Thanks

Sorry if this is in the wrong forum

  • Registered Users, Registered Users 2 Posts: 39 Orange Juice 935

yes two for 2:50 when the signs said 'two for two' that means any two Cokes, eg Coke Life and Coke Zero

for the seven years they have been selling two cokes for two euro

for the last two weeks they have been selling two cokes for two euro fifty cent (02:50)

the thing is they have never changed the sign out the front that says "two for two" or the little cards that say the prices

They have mislead me and god only knows how many others

Have you said it to them?
Or maybe they were anticipating the sugar tax in today's budget.

The sign is only an invitation to treat. When you got the the counter the shop assistant said that'll be €10 and at that point you paid by card/cash and accepted the price the assistant quoted you.

But the little card that sits under the shelf has never changed when i read it today it still said on card 'Coke one 1:40, Coke two 2:00'

Why did you not bring it to their attention?
And it sounds like you drink an awful lot of coke..

I have a question that may help to clear things up, you drink coke, like coke and buy coke - why orange juice?

  • Registered Users, Registered Users 2 Posts: 1,433 ✭✭✭Needs Must

The coffee was good value at 1.50 though.

    i will tomorrow

And yes i know, but to be fair i used to drink two a day in secondary school, now it's one a day slowly going down to one every few days

Casting my mind back to first year business studies, they aren't obliged to sell to you at the price displayed.

Also, seriously, lay off the Coke.

You can't get the money back in contract law but is is misleading advertising and you can complain to the Director of Consumer Affairs and the Advertising Authority. Make sure to photograph the sign of 2 for 2 showing beside a current day newspaper. Tell them you are going to report them.

Might do that, i don't mind spending the extra money it's just that i was mislead out of 4 euro without my knowledge

It doesn't have to change, like I said the sign is only a invitation to treat. The price is shown on the till or the shop assistant will tell you when you bring the coke to the counter. At that point you say yes or no and pay or not.

True but they've never told me the price for any of it, just the total altogether. You also have to ask for the receipt (even thought it's a petrol/diesel station)

Or you could just bring it to a manager's attention... and save everyone a load of time.

If they told you the total and you paid then you agreed to the price the shop set.

If you haven't noticed you've been paying more the last two weeks I'd suggest have a coffee before you leave the house and wake yourself up a little more before making any financial transactions.

What is the good of that? A shop doing that is committing an offence and should be outed. It is people sitting back saying nothing that is allowing shopkeepers to get away with murder. If that shop waqqs surrounded by a howling mod the first day they tried that scam on, it wouldn't be going on still.

I'm surprised the school student's say anything because usually teenagers are the more vocal, or maybe they're protesting

They probably don't even look at the price display, too busy walking around with earphones in a zombie state.

Also the fact that the OP only noticed the discrepancy when paying with cash rather than a card ....

    First world problem.

This is singularly one of the most annoying phrases on chat forums. We are a first world country so of course first world problems apply.

    Do I understand this correctly?
I could sell an item in my shop and hang up signs that state "item X €1" but at the till I charge €2 for it. Anyone who notices, I tell them "well, you're welcome to leave it then" and anyone who didn't notice and paid the two bucks and comes back, I tell them "too late, you've paid, take a hike"?
And that is legal? I'm genuinely curious.

From the point of view of contract law; yes, but you might have difficulties with misleading advertising. Too many contributors are parroting off the 3rd or fourth contract law case they learned. The real world is different.

You really should contact the Gardaí in cases of murder, if that shop was surrounded by a howling mod they would start selling brylcream and vespa accessories.

In all seriousness though, has the op even brought the matter to the attention of the manager... perhaps they're busy and it's an oversight and they would be appreciative of the comment. Might yield a quicker result rather than summoning outrage on d'internet.

Go in, select two cokes, and at the counter offer a €2 coin for payment.

That should bring it out in the open.

There are regulations relating to shelf edge labeling and the shop seems to be breaching these.

Can there an absence of consensus ad idem relating to price only?

Has the shop signed up to a Scanning Code of Practice (check front of shop for notice)?
