Another HAP question!

    Does anyone know if I accept a property and the landlord asks for deposit and first months rent up front does HAP refund me the first months rent less whatever the differential rent is or does the landlord get paid twice whilst I have paid the first months rent and then rent to the council on top?

    It can be very confusing because HAP pays in arrears. Which means if your landlord wants to be paid in advance (which is usually standard), you're going to have to give the first month upfront to allow any subsequent payments to cover the month in advance instead of in arrears.

    So I've managed to get a place and paid the first months rent and deposit up front.

    I've had nothing but trouble with the agent - there was no washing machine, the apt wasn't painted as promised, the toilet flush wouldn't work and the heating is broken. I also got clamped in a space that came with the apartment because the agent forgot to register my car with the management company. I had to pay €120 to release it so I could go to work and chances are I won't see this again. The agent is now telling me that I will have to pay full rent on the 16th if HAP haven't sorted things at their end.

    Do I have to pay this or does HAP backdate? I'm reluctant to pay them anything to be honest given the state the property was in when I was handed the keys and given that the apartment has no heating - I turned it on the first day I was there and whilst I went into the back to make beds the fire alarm went off. I came back in and the room was filled with smoke coming from the heater. They know about this over a week now and still haven't sent anyone out!

    Dora, if your lease says (as all do) that rent is paid a month in advance, then that is what you have to do. HAP is paid in arrears but you lease agreement is payment in advance, if you do not pay, the EA will tell you that you are in arrears on your rent, breaking your tenancy contract, and in danger of receiving notice. HAP is a method of subsidised payment for you the tenant, your lease is your binding tenancy agreement and the payment frequency and time is on the lease you agreed to/signed.

    Landlords cannot discrimate against tenants in receipt of HAP, but you/LA cannot dictate to your LL that timing of rent payments be changed from advance to arrears. This is one of the many reasons why landlords are reluctant to let to HAP recipients.
