Illness benefits took my wage

    I checked my payslip and it said -3256 from illness benefits, so I got not a penny to my for the month I did not receive a warning in writing or otherwise. I started a new job 5 month ago and I relocated for this opportunity.
    I moved to Cork we’re rentals are scares and if I do not my rent on time my land lord has the right to evict without cause in the first 6 month of lease agreement.
    My questions is can they touch my money with out cause or warning.
    I was on sick leave for 1 yr and 9 months, I believe I’m entitled for 2 yrs sick benefit.
    My question is can they take my money and leave me starving for the month and possibly homeless for me and my family.

    The only time I've seen a deduction from wages, and even then it would be reduction in tax credits only, was when something was incorrectly claimed. It doesn't sound right that they never informed of the deduction.

    Even with a deduction they usually do it over a number of years, and not straight away.

    My advice is to talk to Revenue.

    I was on sick leave for 1 yr and 9 months, I believe I’m entitled for 2 yrs sick benefit.

    If you were out sick for 1 year and 9 months why would you be entitled to 2 years? Surely you'd only get it for the 1 year and 9 months.

    Hold on maybe I am picking this up wrong
    You went out sick due to 'personal issues'
    Claimed illness benefit from social welfare which you were entilited due due to previous social insurance contributions

    You Returned to work and your current employer recouped the payment to you from social welfare on their behalf ?

    Or is it something else ?

    Because what I think doesn't make any sense :( because you were entilited to that income and it should not be taking back

    Sounds a bit funny to me.
    It'd Be the DSP that you would need to talk to IMO.
    Did you continue to lift benefits,after you started work as thats what it sounds like?
    Why would you be entitled to 2 years illness benefit if you are only sick for 1yr 9mths?

    624 payment days (2 years) if you have at least 260 weeks PRSI contributions paid since you first started work,
    or
    312 payment days (1 year) if you have between 104 and 259 weeks PRSI contributions paid since you first started work.
    We will contact you before your payment is due to stop telling you when payment will stop and what your options are.

    That's not it. This is more than the payment being stopped. This is recouping an overpayment of some sort.

    I think in this sentence OP meant that we can draw illness benefit for up to 2 years, and OP was only on sick leave for 1 yr 9 mo.

    I can't speak to the rest of it.

    Did the OP get sick pay from their company AND the social welfare payment each month, and now the company have taken back the social welfare amount?

    I would have thought a person is entilited to claim illness benefit where they satisfy the social contributions and conditions whilst on sick leave

    If an employer wants to pay sick leave simultaneously that I would imagine that is company policy .

    Sure how would an employer know person X has even applied for illness benefit during their absence

    Just my thoughts

    If I am not mistaken Illness benefit is taxable , if you have been getting direct payment to your account tax would be deducted upon coming back to work , if your benefit was paid through your workplace then payroll would have deducted relevant tax. I might be wrong..

    Most companies would have it in their policy that they pay the full salary LESS the illness benefit, I always had to prove how much I received (copies of checks etc) and either hand the check over or face a deduction for the same figure.

    Considering the difference between the illness benefit and my salary I was grateful to be getting my salary.

    You are 100% liable to pay tax on illness benefit. A very rough calculation of of €188 per week for 90 weeks, by 20% tax is approximately what your deduction equals.

    Your employer should input the total amount of illness benefit and charge you tax on that. Any payroll person with half a brain will spread out your 17k over your last three pay periods of the year so you aren't murdered in tax as you appear to be here.

    My understanding of the taxation of illness benefit is the following.
    In all cases your credits and bands are reduced by the illness benefit

    If work dont pay you since you only earn around 10k for the year no tax applies assuming no other income.

    if they do pay you one of the following applies:
    You hand over the payment to them. They show it as a separate line on the payslip and tax you on your gross less the benefit.
    You dont hand over the payment to them. They reduce your gross by the payment and that what you get.

    Also from reading the post the OP started this job in April this year. So after getting the illness benefit so why would the current employer be sorted out the tax from 2015. surely that is sorted out directly with revenue.

    Rang citizen information they advices me as well that it is illness benefits issue.
    I’m gonna walk my hounds then I ring the tax office and they prob refer me back to illness benefits.

    The figure you quote is roughly 17 weeks of illness benefit which would be the first four months of this year.

    Sounds to me like your company made a mistake and instead of deducting the tax due they deducted the entire amount.

    Most likely Revenue sent out a revised tax certificate for this year with the illness benefit included and payroll have calculated incorrectly

    My employer got back to me and they said they received a letter from social welfare and I owed them money.
    But I didn’t claim social welfare only illness benefit and illness benefits even said everything is fine.

    Did you pay the tax on the illness benefit? If not you do owe them money. On our payroll software it shows as the full amount as being taxable so you pay tax on that amount but are you saying the full amount of illness benefit has been deducted from you?

    Could you blank out your personal details and stick up your payslip here for a look? We'd have a better idea then.
