foreign landlord

    Hi,

    I have just found out that a previous landlord of ours was not resident in the country for the duration of our lease. During the time I had to fill out a form12 as I own a rental property myself. On the paper form 12 there was a section that relates to foreign landlords (or similar, I cant remember the exact wording) which I left blank as we did not know where the Landlord lived. we only had a number to call if there was an issue. Rent was lodged directly into the Landlords account.

    I don't want revenue to have an incorrect record for me but I don't know what they would have to say about not declaring that we were paying to an out of country landlord as I have seen that we could be liable for the tax paid on the rent to the landlord. Obviously that is a crazy situation and one we cant afford to pay.

    What should we do here?

    Did you pay the landlord directly, or did you pay an agent? Did he tell you he lived abroad, and what address did he put on the lease as his address?

    We rented through an agent. they did not state the landlord lived abroad and we paid directly into an Irish bank account. Don't remember the lease exactly but it didn't stick out as a foreign address. Cant find the lease to be 100% sure as we are out of the property over a year now so didn't think to keep it.

    The agent is supposed to take care of it if there is one so no worries.

    Even though it is an offence to give false information on a return to revenue? I am just concerned that down the road if they did spot it that there might be some comeback against me. Has anyone ever heard of anything like that?

    I could be wrong but isn't the section on Form 12 regarding foreign landlords only to be filled out if YOU are a foreign landlord, not if you're renting from one? You're not completing the landlords tax return, just your own.

    Yeah I would have thought that too but on a few threads I have read it seems that the tenant could be liable to hold the tax due by landlord. It just isn't very clear and I cant really see how a private citizen could be held accountable for another persons tax.

    That is true and it's enshrined in legislation but from other threads on here Revenue don't tend to chase tenants for it anyway, and if they do only from the point you become aware of the liability. You say it was a previous landlord and you're only becoming aware of it now so I personally wouldn't be worrying too much.
