CLAMPERS

Hello Everybody, Long Time Lurker Here, Just Looking For People's Opinion On A Incident I Had Today. So I Was Parked In A Private Car Park For The Day And End Up Getting Clamped.

Could Not Believe My Eyes When I Came Back As I Had Paid For The Full Day! Took Me A Few Seconds To Realize That My Ticket Had Fell Down Slightly And Could Not Be Seen, Must Of Been When I Shut The Door,

So I Thought A Quick Phone Call To The Clamping Company To Explain The Situation Would See Me Free To Leave As I Have A Ticket With Date/Time, Time Purchased etc.. And I Park Here Every Day No Probs.

No Chance They Tell Me, Should Of Had It Displayed, Charge For Release Is Going To Be E125 Plus e8 Card Fee? How Do You Want To Pay? Did Not Care That I Had Already Paid And Had a Valid Ticket. Tough Luck Basically.

So After Another Few Minutes Realizing I Was Not Getting Anywhere, I Just Cut It Off Put It In My Boot And Drove Home. They Called Me Back Within Minutes Of Leaving To Tell Me That If They See My Car Parked Anywhere In Dublin City They Will Tow It Away. This Is A Private Company.

My Opinion Is This Kind Of Practice Is Just Straight Up Extortion, So What Do You People On Here Think? Was I Wrong To Cut It Off? Would You Just Pay up?

Now you owe the fee plus for the clamp. They can also report you for criminal damage. Not the smartest move in the world if it happened as you say.

Parking ticket must be displayed at all times. How else would they know if you paid or not. They take photos of the car, dash etc showing no ticket. Photos are time stamped. Producing a ticket after the fact is no use even if it is for the whole day. I don't doubt your honesty but the driver of the car beside you could have given you their ticket at the end of the day.

I leave my ticket on the dash facing up, close & lock the door. Then I take a photo with a time stamp of the ticket on the dash. It's never happened to me but I would at least be able to prove I had to ticket displayed on the dash

    Hi again,

    To answer the questions asked.
So What Do You People On Here Think? Was I Wrong To Cut It Off? Would You Just Pay up?

What do I think? I think I don't believe you, for a start.

Were you wrong to cut it off? It you did, then of course you were wrong as it is criminal damage.

Would I have paid? Yes, as I had not displayed the ticket. But I would then go through the appeals procedure.

f*ck em! They're a horrible crowd. I once got clamped a while back when there was a construction truck blocking the sign that said pay and display.Pay and display had just been brought in and i didn't realize this was the case. I later took photos of the articulated lorry blocking the sign and appealed. Got a letter refusing to refund me. The letter didn't acknowledge the particulars of my situation at all. It was just some standard thing they send to everyone. If it happened again I would remove the clamp myself as you did.

How would they have the right to tow your car if they see it parked in town?

Once they clamp you forget any refunds. They're vultures. Correct me if I am wrong but I think the clampers themselves might even get commission?

Why were you carrying around the means to cut a clamp off?

  • Registered Users, Registered Users 2 Posts: 8,184 ✭✭✭riclad

You,ll have to pay the parking fee plus maybe a fee for cutting the clamp.
on some days i see clamps on the roadside with no chain cut.
i think it,s possible to remove a clamp by removing the car wheel.
hold on to your ticket , just in case you need it if they take you to court.
A woman phoned up newstalk, she was clamped at a dart station ,she had a ticket from
    ticket machine 2,
ticket machine 1 does not work.
i think she was in the zone for ticket machine 1.
She went to the local gardai, she said she removed the clamp and will
give them back the clamp if the meet her at the garda station.
she had a ticket bought at 9 am, they clamped her around 10am.
I think the only way to get a refund is to take the parking company to court .

In a private car park the only way to appeal is through the courts.

The champers can't seize your car, but you may well be hearing from their solicitors. Gardai are unlikely to become involved as it is a civil matter.

    Private clampers are scum.

My brother in law got clamped in a hospital carpark. His 39 year old was terminal with him being called in to say goodbye. She died the following morning.
No amount of explaining to the piss stains who clamped his car would suffice .

There's nothing really to say about those two men who clamped his car. I was there that night as he 'pleaded with them.

    Correct.

First letter of every word is not shouting.

Maybe it's the accepted internet typing style for whining?

Admit nothing about the clamp. The onus of proof is on them. Just say it was like that when you got back.

I am glad I live in Donegal. The only threat of being clamped here is mainly by the Euro Car Parks crowd at the hospital in Letterkenny, who of course should not be there as the hospital car parks were paid for by the tax payer when the hospital was built in the 70's, but thats a different fish out of a different kettle.

Happened me a few years ago at a train station carpark. Clamped although I had a valid ticket. Called them up, told them they made a mistake, they said nope I'd have to pay the fine and appeal it. Had a very obliging person take a consaw to it.

Clamped again in our own parking space, rang (same company) to tell them, again, pay up grounds for appeal. My partner popped the lock on the clamp and clamped the clamp around a lamppost, no damage to clamp and the lock was a bit battered but still locked and I presumed opened with the key so technically no damage.

I've no problem paying fines when I have been correctly fined but npcs are scumbags and twice have incorrectly clamped me and told me to pay anyway and appeal. Nothing ever came of either removal.

Then have them prosecuted for stealing your car. You shouldn't have stolen the clamp though.

If it was the council I'd go along with whatever and appeal.
If it was a private one I'd get the clamp off and leave it there for them, they can go f*ck themselves

Whats more if you ring on your mobile its an 0818 number and with all the menus and confirmations it end up costing €1.50. Total scumbags. The next time I will cut it off.

I hate the clampers as much as the next person and have been down the road of ignored appeals for them incorrectly clamping my car but in your case it's fairly obvious. The rules are to pay and display, you didn't fulfill the second half of this contract so they were well within their rights to clamp you.

bloody shinners, knee capping is grand, clamping is unjust....

Clamping just causes aggro. Whats wrong with the ticket on the windscreen approach for illegal parking? You still have to pay the fine but at least one can drive away from the situation and avoid alot of potential extra trouble.
