    Current lease is up in November. My LL has said he will accept Hap payment. If I sign up to HAP for this current property can I transfer if a better house comes up in a few months? The reason why i'm asking this question is because my current property has damp issues, window leaking and heating problems. A family friend has said that she may have a house avaliable in the new year and would accept HAP.

    If you are on HAP you have to live 2 years in the property before you can move on. If you get a job and have to relocate, you can move.However if the house is not up to standard,chances are it doesn't get approved for HAP unless the landlord fixes the problem.I am on HAP and it took a year before someone from the council came to inspect my house and he was going around with his clipboard looking into every corner. They are quite strict with their regulations.

    So if the property fails the inspection and the Landlord refuses to make the repairs, does the council stop payment to the Landlord resulting in the eviction of the tenant? Can the Landlord then get another tenant who is not on the HAP scheme?

    That could happen. In my case my landlady had to install a carbon monoxide alarm and a vent had to be built into the wall for safety. She did that right away. But the inspector has yet to return for another check. I think it has to do with liability insurance, say if the landlady doesn't comply and anything happens to me she or the state could be sued for compensation. HAP or not , in any case it is a legal requirement now to install smoke and carbon monoxide alarm in rented property.
    I honestly don't know if the landlord could just get another tenant who is not on a HAP scheme after he was checked by a council inspector. I would say it is up to his choice who he takes on as a tenant afterwards.
