Non Compete

    I was a business partner in a ltd company. I got an offer from a multinational in the uk at the beginning of 2016 and moved there in March after negotiating the sale of my half of the business to an employee. When I bought into the business I signed a non compete which restricted me for 18 months after I left from opening a business in competition in a certain area of Dublin. When I sold my shares I signed another form which had a 3 year non compete clause that I would not open a business in the whole county of Dublin. I signed it as I thought I would not return. But Brexit happened.

    I am now back in Dublin and my spouse and I wish to open a business. This is not a speciality sector and there are lots of similar business throughout Dublin. I will not open anywhere near the business I sold. I do know that customers will come to me from the previous business.

    My question is if I open a business and put it in my spouses name who will also work in the business and I become an employee would that violate the non compete contract?
