Do I need to file a tax return for income less than €5000 - non resident?

    Hi I'm really confused after speaking to revenue. I'm a non resident with a house rented out - the total rent is way below €5000 PA.

    According to the website if you are below €5000 income you can submit form 12 online in "my account" and submit form R185. If you are above €5000 you have to do a self assessment via form 11 and use RoS.

    My agent is deducting the tax from the tenant and has paid it to revenue. They have given me a form R185 showing this and the revenue office have stamped it. I mentioned this to revenue (business side) on the phone and I was told this is completely incorrect - they said the agent needs to be registered to pay any money to revenue and they and I have to fill out a 'collection agent notification form'. I did not mention it was below €5000. His advice seems to contradict everything on the revenue site. Or is it that by default, the fact I am non resident means I have to go the form 11 self asssessment way?

    The Form 12 is only for people with Irish employment income.

    If you have no Irish employment income you need to file a Form 11.

    The collection agent notification form would entitle an agent to collect the rent without any tax being deducted by the tenant. The collection agent would however be responsible for filing the Form 11 and paying any tax due.

    Hi thanks well that would make sense because I can't register for ROS myself having no irish tax reg number,

    Any individual or entity with an Irish tax registration number already registered for a business tax e.g. Income Tax, VAT or Employers PAYE. Individuals who are registered for PAYE or LPT only should register for myAccount"

    The form R185 has been filled in by the agent saying the total gross rent and the amount deducted and paid to revenue on my behalf. It has been stamped by revenue. The guy I spoke to could not see this payment, where on earth has the money gone?
    So I need to tell the agent a mistake has been made and ask the agent to fill in form 11 and send off to revenue?
    I've had a look at this 36 page form11 online and there is so much info that the agent wouldn't have about me about to complete and file. Would I complete it as far as I can then send on for them to finish off and file with revenue?

    I was given a blank "Income Tax Registration Form for Collection Agents" Is this the correct notification form the agent should have filed for me?
