Delayed window replacement

    I'm having an issue with a window manufacturer/installer. I'm wondering where I stand in terms of being compensated for the delay and inconvenience.

    Ordered windows from a Danish manufacturer, lead time of eight weeks which actually took ten in the end. There was a mistake in the size of one of the windows which transpired to be a mistake when it was made in the factory. It was measured correctly.

    The company offered two options. Have the materials to make the window sent to a spurious manufacturer in England and a new window made by them, have the frame installed here and then the sash sent back to Denmark to have the glass fitted.
    Second option was to have a new window build in the factory and resent. Lead time of 10 weeks this time.

    We made the decision to have a new window made at the factory. We were lead to believe that it would be here September 25th.
    We found out yesterday that we won't have the new window until October 11th.

    It will cause major delays on getting the bathroom finished off. The installer here in Ireland doesn't seem to care.

    Where do I stand in regards to a discount or reimbursement for the disruption and delay caused? I can understand a bit of a delay to rectify their mistake but this is ridiculous.

    Unless they signed a contract that stipulated "Liquidated Damages" I'd say you have little to no chance of recourse by "official means." In fact it's more likely that they got you or the Irish installer to sign a set of "terms and conditions" that specifically absolves them from any responsibility they can get away with. The whole thing is made doubly difficult by the supplier being in a foreign company.

    I think your best bet is to make verbal enquiries and try to negotiate a discount due to the disruption (with the knowledge in the back of your head that you probably don't have much chance of getting anything if you decide to pursue it "on paper"

    They finally fitted the window last week. They did a terrible job on some of the cills though. Measured them incorrectly a bunch of times. There's one that still falls towards the house rather than away.

    The cills as described are not fit for purpose. You might want to suggest a Small Claims action against the supplier for the cost of having them rectified if they don’t rectify the installation. The story about having the window remade in England and glazed in Denmark is patently nonsense. What sort of certification and warranty are you getting as a matter of interest ?
