Child benefit /shared custody

    Hi
    My husband have two boys age 10/12 my question is who is entitled to receive the child benefit as he join 50/50custody.
    The boys spent a week with us and a week with their mother
    I am the one who looks after them after school as my husband need yo work.
    I know his ex is in a stable relationship and working full time but she get the the child benefit for both child and we always have to pay half of any after school or trip or anything else.
    When my husband asked her to use the child benefit to cover back to school books etc she said that the money is there to entertain the boys...
    I am wrong here as they spent same time wich each parent I guest the benefit should be split..
    Can anyone give me an advise...

    One needs to take into account any maintenance payment that is made between the parents. 50:50 custody doesn't mean there is no maintenance payment.

    Where children reside part of the time with one parent and part of the time with the other, child benefit is payable to the parent with whom they reside more of the time.

    If they reside 50% of the time time with each parent, child benefit is payable to the mother.

    There is no provision for splitting the child benefit, but of course the fact that one parent is getting it and the other is not is something that can (and should) be taken into account when calculating any maintenance payments that one parent pays to the other.

    What happens if a child is placed in foster care? Is the benefit payment suspended ?

    Normally the parents can still receive for up to 6 months, but if its a long term placement then the payment can go to the foster parents.

    Foster parents also receive a separate payment.
