Falsely accused of speeding by the guards.

    On the 29th of April,I was stopped by the guards for speeding. I have a black box in my car that monitors my driving, mainly speed. I know myself that I wasn't speeding and the car had monitored that I wasn't speeding also. I looked into whether to fight or just pay the fine, and it seems that the rick would be too high to fight. As a learner driver, If I end up in court and lose , I would get 5 penalty points. I find that the only realistic option I have is to pay the 80 euro fine and take the 3 points.
    Has anyone else experienced this, especially at the end of the month?
    Can't help but think the guarda's ticket quota has something to do with me being given this ticket.

    I'm am very sure, its my home road. Its a 60km road, and they said I was going 90km.

    Did you tell the you had a monitoring box?

    If not, contact them and explain you have data to prove otherwise and they may just drop the case before a court appearance.

    If it was me, I would fight it. Were you shown your speed reading when stopped? Do you have your black box logs? If you do, and the black box is reputable (e.g. a calibrated device issued by insurer) it casts enough doubt on the reading to have the incident thrown out.

    How much data can you get from these black boxes?

    If you can produce weeks of records of you travelling below limit on this road would strengthen your case.....assuming you're always on your best behaviour ;)

    90k in a 60k zone is 50% over the limit.

    That's a lot to be over it.

    How did the Gardai clock you at 90 ?

    When the guards stopped me, they showed me the speeding gun. It said 90km, I'm not sure why I was stopped. It wasn't my speed that they showed me.
    In relation to the insurance company , I get a weekly update stating if I was speeding or not. I got the message saying I wasn't.

    That is not nearly enough to challenge the guards on. You would need a detailed log giving time, date, location and speed that matches the alleged offence.

    Also helpful would be a statement from someone responsible for the monitoring equipment verifying the specs and accuracy of the system.

    My guess is that if you ask the insurance company for this data and statement for the purposes of challenging a speeding fine they will roll out the excuses and quickly backtrack on their advertised claims of accuracy for the product.

    It is worth a try to call them out and get it quashed but I would say that if they don't back down you would need a solicitor well versed in traffic law to get your evidence taken seriously in court.

    Fight that....You got confirmation already that you were not speeding.

    No bending over for the incompetent fcuker who incorrectly picked out your car.

    If there is any justice that will be thrown out of court the second you mention it.

    You need to be surer than surer. Your data must trump theirs and that's a tall order. If you are certain then engage a solicitor and fight the fine and points.

    Look at it this way - OP has a black box fitted so is very aware of speed and limits, more than the average driver and weekly reports see to this. How likely is it that the OP had a single short and sudden burst of speed (50% over the limit) that went undetected by the black box, but by cruel coincidence was picked up by a Garda with a gun? Or is it more likely that the Garda pulled the wrong car in?

    Could you talk to a solicitor who has dealt with similar cases before.

    Sounds odd. I would be suspicious of the reading he was shown.

    Were there any other cars in the vicinity when you were pulled?

    Was there another car in front going faster? Could it have been mistaken identity? Have you got a dash cam?

    If it was 29th April you're over the time limit for appeal to the Garda anyway.

    Step back for a moment.
    You're a learner, did you have a full licence driver with you and L plates up?

    If not then I'd strongly suggest you don't fight this as you'll likely end up in a much, much worse position.

    If you have a dashcam ,could you prove you weren't speeding? Even if there's no GPS speed on the dashcam.
    Just by using the distance and the time it takes to cover that distance?
