    Hi i work 40hr a week 5 days a week full time my employer only gives me 2 weeks off in the summer and 1 week at Christmas (1 week includes Christmas day and Steves day) am i entitled to more?

    Under the Organisation of Working Time Act 1997, you are entitled to a minimum of 4 weeks paid leave per year (assuming you work more than 1,365 hours - which you do!). This excludes Public Holidays.

    So yes, it would appear that you are entitled to an additional weeks leave. Do you never get any other days off throughout the year?

    Also if your week at Christmas includes the Christmas and Stephens Day bank holidays, it would only use 3 days of your 20 days annual leave, not 5 / a fullweek of leave.

    Underpaid for holidays, you are entitled to 29 including bank hols and only getting 15. Maybe underpaid is the wrong word but you are being shafted.

    I do no its up to employer to decide when holidays are taking.

    Everyone says im entitled to 20 days paid. Im only getting about 13 days a year. Im the only employe that have anything to do with it?

    You are entitled to 20 days holidays, not including public and bank holidays. For Christmas time, if the business closes for the entire week, (Dec25th - 29th) you have to keep 3 days annual leave as there are two public holidays within that week. Therefore you have 17 days for the year to take at your discretion, providing the dates are suitable for your employer. Either way your employer has to give you these holiday days each year.

    I presume you mean you get 10 days off in July and return to work immediately after that. Its 20 days per year plus bank holidays. Not entitled to the bank holidays off, think they can offer a different day off, a day pay or an additional amount to your pay in lieu of it.

    No don't do that. First port of call is the employer to try and get them to resolve the situation. If they only have one employee it's possible they just don't know the rules.

    How long are you there op?

    If that was the case their employer would be themselves, that doesn't appear to be so from what they've mentioned in the OP.

    I hope some teachers read this thread on their minimum 8 weeks holidays , so they know what other people are being shafted with... they might shut their faces about not been paid for yard time or changing the junior cert geography syllabus payment or whatever they can moan about next.

    I work in the indurtrial sector, I'm not in the civil service, like I said, it must be a company thing, as in their discretion.

    Yeah, as many other people have already pointed out extra days are at a company discretion. I get an extra day at 3 years, another at 5 years etc.

    I think you are confusing statutory and desretionary entitlements. Many companies may give additional days at their discretion, but they are not required to by law. You won't find multiple references to the legal requirement, there aren't any, you may find many references to private companies and public services which do give additional leave days due to collective agreements with employees and/or unions.

    You seemed to state in an earlier post that there isi a statutory entitlement of one additional day after five years, due to all employees including the op. That is not correct.
