Holiday problem after handing in notice

    Hi,

    I have handed in my notice to me current employer and have given my correct notice period of two months.

    I am due to finish on the 1st September.
    I currently have 9 holidays left to take as I haven't taken much time off this year.

    I asked my job I would like to finish 9 days before my final day of September 1st. However, they have said no and have told me since I have handed in my notice my holiday entitlements are gone and they will just pay me for the nine days once I leave. I'm not sure they are allowed to do this as I Believe I am entitled to two consecutive weeks holiday each year.

    Any advice on this?

    From citizens information...

    "Holiday pay: If your employment is ending, you are entitled to receive a payment for annual leave which you have earned but not taken. The payment should equal the amount that would have been paid had the annual leave been taken. The ending of employment is the only situation where it is legal to pay an employee instead of giving annual leave."


    So basically your employer is right. So long as they pay you for the nine days they are working within the law.

    Obviously, there is nothing stopping you calling in sick for 9 days if you want the break though.

    This is 100% correct as long as you are sure that the job you are going to will be your job for life and you will therefore never have to use your present employer as a reference again.

    Yeah mate sorry,

    the purpose of notice is that you're there to finish your tasks, allow the company to find a replacement and hand over your responsibilities to someone else.

    If you were allowed to build up holidays and disappear half way through your notice it'd be a bit of a balls to your employer. Even if it wasn't against the law it'd still be uncool.
