Employment rights - discrimination?

    Hi all,

    I'm currently dealing with a rather annoying situation:

    The company I work for is part of a company that has 4 different locations. The overall company is a huge multinational that has bought all the locations.
    The Multinational has a Bonus system.
    However: In 2 plants, everyone gets the bonus, in 1 plant only the managers get the bonus. (no info on the last plant).

    In my view this is discrimination - either noone gets a bonus or all.
    Anyone any experience with something like this? was it ever resolved? If yes, how?:mad:

    I would agree with this were it not for the fact that I am in possession of an email outlining the bonus system and it clearly states it's not related to personal performance but company performance..and all employees on a fixed employment are eligible.

    It might not be fair but its legal.

    Lots of companies have employees with different terms and conditions.
    In this case, it sounds like the company bought 4 different companies and have not change the T&Cs for the employees.

    The employees in plant 3 were never promised a bonus. Once their previous T&Cs were legally transferred under TUPE, their new employer has no legal obligation

    I doubt if the email you have is legal binding on the company to have the same bonus structure for all employees but it should be used as a negotiation tactic.

    It's absolutely discrimination. Discrimination is not illegal except under specific grounds.
