Public or Private Road?

    Would anyone know how I would find out if a road is public or private. We were always of the opinion that our road was public but with construction of new homes opposite, the builder has informed us that it is owned by the construction company.

    If there any way of finding out?

    ask the roads section of your local council.

    they will have maps on every road they are in charge of.

    A lot of roads are owned to the centre white line by the house / field next to them... And will often show on the maps as owning half the road in front of them...
    Doesn't matter if the road is under the council's charge...

    That doesn't necessarily bestow any usage into them though.

    Id turn your statement around and say that often public roads are technically owned by landholders as land registry maps will show the land building to the centre of the road..... But that doesn't matter as the council will have full control over the road.

    Irrelevant as the land owner can't do anything under the road without council permission.

    I think the OP is in a housing estate so the issue in question here is if the roads have been taken in charge by the local authority.

    OP is there a management company for the estate? That'll be your first port of call. They should know if the original developer has transferred the land to them or someone else.

    tks guys. We live in duplex apartments so do not own the ourside of our building. The new developer has stated that they now own the road which is causing issues for us as the new development is taking away our parking from the other side of the road - if that makes sense and reducing the size of our road and is claiming they can legally allow HGV and construction vehicles up and down our road.

    Will get in touch with council and management company tomorrow

    The apartments are a mix of shared ownership and council rented properties and for past ten plus years the road was considered public.

    Unless fingal have now transferred ownership to the new developer?

    Well if it is a public road they do have the right to bring hgv s up and down it..
    They'd have the right to available parking too... But dóubt they'd have the right to block residents parking.
