Hi all, I have a question hope someone can help me. An Irish registered company bought a counter (goods) from a UK company to be delivered to its store in UK. Should VAT apply to the invoice? I would be grateful if you can provide me the VAT legislation reference, as I have to provide that to our UK supplier. Thanks

sale of goods in the uk by a uk company are subject to VAT. VAT exemption only applies if the UK company is exporting the goods to Ireland intra-EU

Thanks Clevtrev. When we post the invoice, Should we post the gross amount (dont claim UK Vat) or posting the Vat and net amount separately?

Well I assume you know you can reclaim the UK VAT paid. You can reclaim it from via ROS I think. You could setup a new vat code to hold the uk vat until you have reclaimed it (but if you have an automated VAT3 you would need to ensure it doesnt get mixed up with your regular return).

Someone else may have a better suggestion

If the Irish company has a store in the U.K. Shouldn't they be registered for VAT in the U.K. also?
