Nuisance barking dogs.

    I am considering using the district court in the case of nuisance caused by excessive barking of dogs by a few of my neighbours
    I have already spoken to them in this matter but to no avail.
    What proof of nuisance do I require for the court, as I am sure they will deny any problem they are causing.

    If you don’t get a satisfactory response, you may complain to the District Court and seek a hearing. When you have received a court date, you must inform the dog owner of your complaint by using the form prescribed for this purpose under Section 25 of the Control of Dogs Act 1986. These forms are available from the District Courts and from local authorities.

    "The court may make an order requiring the occupier of the premises in which the dog is kept to abate the nuisance by exercising due control over a dog. The court may limit the number of dogs that can be kept on a premises or may direct that a dog be delivered to a dog warden to be dealt with as unwanted."

    Regarding the last part I don't think I have ever heard of a case of this happening where an owner was order to hand over a dog for barking. The dspca have a difficult enough time prosecuting neglectful owners nevermind ones whos dogs bark to much.

    In all honestly though there isn't much that can be done, only a strictly trained dog will not bark unless instructed to and most owners don't go to them lengths to train their petd and you have to compete with cats and birds coming into dog territory etc winding them up.

    I've asked this question and been told the coco have to initiate the case. I was unconvinced because I read it in exactly the way lifeandtimes read it. We are plagued with barking dogs Kilbarrack, about my only bad word to say about the area, and a problem in Ireland in general IMHO - people seem to have this odd attitude of 'it's a dog it barks' - no it barks because its frustrated and you don't have control of it - but I digress.

    You'll get bugger all help, the owner will likely ignore the court date and the best you can hope for is a fine for not having a license and possibly a neighbour who doesn't take kindly to being asked even politely, let alone a potential court date.

    EDIT: Sorry my practical advice to go along with my rant is ear plugs, they're pretty effective with that sort of sound.
