Work Roster and Data Protection

    Hi All,

    I have been requested to show my work roster by the other party in a family law case. Before I do I'm wondering is there any data protection issues in doing so, my roster contains the names of all of the staff on my team, the days they work on a week to week basis including holidays booked and training days etc. There would be a total of 4 months worth of data.

    I thought of blanking out the names and days of the others but I don't know how that would play with me altering the documents, or does blanking it out constitute altering?

    You can blank out names and details of other employees if you wish and leave only details pertaining to you.

    The judge will not care about this.

    But even if you left them in I'm not sure how it would be a data breach for someone to see someone's holidays and work schedule in a court case as family law cases are closed i.e. of camera and details of which are not released publiclly. The only people seeing them will be the judge and solicitors who understand all about clients privacy and court room procedures

    Thanks for the info. My fear is that the other party is friends with a member of my teams sibling. I'm also not to keen on handing over my roster to the other party. Is it possible to just hand this to the judge to allow him make his decision?

    The DPAs contain an exemption for the administration of justice so I wouldn't concern myself too much over whether I'm obliging the DPC when it comes to cases that are actively before the courts.

    If it's evidence I assume the other party will also need sight of it. I stand to be corrected I'm not a lawyer. My practical suggestion is two copies, one with the info redacted the other complete. Hand the first one up and see how you fare.

    In fairness, you don't want to hand over your roster, your concern isn't really data protection.

    That said other peoples work rota isn't your data to share. Its your employers. But you don't need everyone else's rota. Just your own.

    If you made a copy of just your rota and got your company to agree/confirm it, that's all you need. Its hardly an unreasonable request. No?

    Who is actually entitled to see this in your own case, judge etc. I have no idea. I'm guessing you think its an unfair request.

    I'm not sure what difference it makes.

    If the OP has a "case" then surely the administration of justice requires that it is dispelled fully before an independent court of arbitration, whether that be the Court or another body deemed capable of considering the points?

    I might be wrong.

    Its a family law case for varying access. In regards to the roster, I just want it to be clear that I don't mind the other party knowing my rota which is a set 4 week repeating rota, my issue would be in regard to my own privacy when it comes to the time I take off. I'm thinking I might have the roster on stand by with a few copies and a write down the rota, speak with the judge to voice my concerns and hopefully he can view the roster and confirm the rota.

    The other party will be required to view it and this is through my own experience however you can blank out other team members.

    Can you just bring the 4 week one then?

    You can't blank out the holidays you have planned but you are entitled to take them and if your ex gives you cause for concern knowing these days then that's not a matter for the judge but for the Gardai instead. This is an unfortunate issue regarding family court

    I don't see why you can't get your boss to sign a letter on headed paper confirming your own 4 week rota. No mention of anyone else or holidays. It is only for the purpose of assisting with orders re access and the fact that occasionally there will be holidays shouldn't matter,
