Return rights for item from China?

    My mother recently ordered an expensive dress & matching shawl online for a wedding. She didn't realise the site was based in China and had to paid ~€75 customs/import duty to receive them.
    Expensive mistake but all above board so far.
    However, once she received the dress and tried it on it was not the size it was supposed to be and was very poorly made. Shawl was correct size but might as well be made out of paper.
    She got onto them and after several emails they offered a 10% refund on the dress (not including delivery or customs fee).
    Do Irish laws apply here? Should she be able to return them for a refund?
    The site is a popular one for wedding related attire.
    Any advice welcome, thanks.

    Something to be aware sizes in China as smaller than sizes in Europe, the laws for EU or Ireland do not apply as the business is in China. If she sends the dress back she can contact Revenue to ask about getting a refund, she might be entitle to some refunds, make sure she keeps proof the dress was posted back.

    She can try contacting her credit card company to check if they can do a charge back, they might ask for proof she's been in trying to solve the issue with the company.

    EU Law: Doesnt apply

    Thats most of your consumer rights gone. So a Visa/MC chargeback is the only option to force the issue if the retailer doesnt play ball.


    Was it through a third party site (Ali, Ebay) or their own?

    Thanks guys, the dress was listed using US dress sizes, she went for a size bigger than she would normally get (after converting US size to our size) and it was still way too small.
    It was (unfortunately) through their own website.
    I've never done a chargeback before so was hoping to avoid it as I'm not familiar with the process, but it sounds like the only option, thanks again.
