Failure to produce drivers licence

    Hi Folks,


    My wife was pulled for exceeding the speed limit and she duly paid the fine (even though the time recorded was completely wrong) and she produced her licence within the agreed timescale at the local Garda Station. She received the letter confirming that 3 points had been added to her drivers licence.

    A few days ago she received a summons by registered post for failing to produce a drivers licence. She phoned the court who told her she would need to speak to the Garda that issued the summons. She phoned the Garda Station and they told her she would need to go to court to prove she produced her licence. Surely the fact that they issued the penalty points to the licence is proof enough that she produced it!!!!

    She has been unable to speak to the Garda that issued the summons despite leaving several messages. It doesn't seem fair that she has to take a day off work to attend court despite having followed all procedures. I know she shouldn't have been speeding but it's been her first mistake in over 20 years of driving. Can anybody advise on next course of action she should take? Sorry for long post!

    Getting the points is not proof that she produced her license.

    She should have made sure that when she did produce it, that it was noted by the Garda on duty.

    Other than turning up to court, she has no proof that she produced her license, but she could continue to try to speak to the Garda in question.

    When you produce your licence it is recorded at the garda station it was produced at. Call in, give the the date it was produced and ask them to verify it and maybe contact the garda who issued the summons.

    She will have to go to court. Even if the prosecuting guard says he will have it struck out, do not trust him/her. Mistakes happen and convictions can be recorded and it is a huge mess trying to clear it up. One of the joys of motoring is having to deal with the administration. Just be thankful she didn't kill someone when she was speeding. Then she would know all about guards and courts.

    It's one area where the Gardaí are continually failing - to give a receipt when a licence is produced at a station which they are legally required to (this applies only to licences and not insurance documents etc).

    People being accused of failing to produce seems to happen on occassion even though they have produced - issuing the receipt would solve a lot of problems in that area.
