If a person is sanctioned by €44 on Jobseekers allowance and said person made an appeal to D'Olier street social welfare appeals office, can this person be disqualified from Jobseekers while the appeal is in process ?.

    Thanks.

Your appeal is over the 44 Euro, not the full amount of JSA.

You will lose the 44 Euro every week until your appeal is resolved.

If it is resolved in your favour you will get the 44 Euro refunded and backdated in one lump sum.

Might take a few weeks before appeals office make a decision.

I have just received new information in regards to my O.P it makes no difference if you appeal or not, you are not fully disqualified.

If a person is disqualified from Jobseekers allowance for 9 weeks for not engaging with Jobpath, you are not entirely disqualified at all, as the person can visit their local Intreo office any time and explain to them that they decided to engage with Jobpath and their payment will be restored.

If a person thinks that they have to wait 9 weeks to re-apply for Jobseekers allowance then this is incorrect. You can just go into your local Intreo office even on the day of disqualification and tell them that you have made the decision and will comply with Jobpath, and your payment will be restored. If the person refuses to comply then they of course will have to wait 9 weeks.

I wasn't expecting to receive this information as I personally thought that once you are completely disqualified from Jobseekers allowance then you have no choice but to wait 9 weeks, this is incorrect as stated, and you can have your payment returned any day you decide to engage with them.

I just thought I'd add this in here just incase someone else needs to know. I wonder why the department of social protection do not include this information in their policy.
