Existing dwelling - Private open space

    Hi,

    I'm interested in purchasing a small house in Dublin 8. The current owner built a single storey extension in 2012/13. The extension is circa 20m2 but the remaining private open space is only 15m2.

    Is anyone aware of DCC taking enforcement actions against a home owner for the 25m2 private open space rule because the extension was not exempt from planning in the first place? They are empowered to take action but is there a desire in DCC to seek out such unauthorized developments?

    The property is not a protected structure or anywhere near an ACA.

    what does this mean?
    because the extension was not exempt from planning in the first place?

    Is it unauthorised because of the open space rule or something other?

    Once unauthorised then you will need to get that rectified because it will always be an issue, regardless of enforcement/time lapse etc?
    Are u cash buyer or debt, if debt they wont lend

    When you are in he process of buying, you bank will request a survey.
    The Surveyor will request a cert of compliance with the planning and building regs for the extension, if none is available , they will request a cert of exemption. If that is not available then the vendor has to regularise it to sell.

    It sounds like it required planning so therefore they will have to apply for retention permission which takes 3 months approx.
