Holiday pay and leaving work.

Hi all, So my employer doesn't like paying out holiday as cash, and he would rather have you actually take it than pay it out and keep working. So as i will be leaving the country quite soon, and there isn't any empty slots for my holiday, is it possible that my holiday hours will actually be lost, or will he be expected…

Hi all,

So my employer doesn't like paying out holiday as cash, and he would rather have you actually take it than pay it out and keep working. So as i will be leaving the country quite soon, and there isn't any empty slots for my holiday, is it possible that my holiday hours will actually be lost, or will he be expected to pay them out when i leave?

Legally, they have to pay your holiday when you leave. You employer might ask you to take it as part of your notice and leave earlier (so for example you give 4 weeks notice and you have 2 weeks holiday so you leave after the two weeks). But is you don't take it as part of the notice they have to pay it.

BTW, in normal employment, you employer is not just allowed to pay for your holidays and you keep working. Holidays are for rest of the employees, and they have to be taken.
