Sold a car

    Hi
    I sold my car last year it was my first time selling a car and a dealer told me that he has to send the log book ( I know it was stupid I know that now ) so it was OK until last week I got etoll fine not big but still got worried . Rang the eflow they told me that I have to contact the motor tax office rang them and they send me the declaration form and I was trying to get in contact with solicitors . And in the meen time I paid the toll because I got afraid that it's gonna get worse . And my question is if I go to the solicitor and get that filled in is the tax office not gonna think its suspicious that I am declaring that I don't own the car which I don't and then I am paying somebody's tolls ...

    Declare fast because tolls will be the least of your problems if this car is involved in an accident or criminal activity. The authorities would be more interested in why you didn't declare as soon as you found out rather than why you paid.

    And what should I fill in when it asks what date was it sold and the name of the buyer

    The date you sold it and the dealers name.

    Yes but I cannot remember the name of the man or the date it was some time last year the whole sale deal was done very quick and I was being stupid and gave him the logbook

    Did he pay you by cash or cheque? Can you check when it was lodged to your account? Did you buy another car straight away (or anything else with the money) and work out the date from when that was registered to you?

    Where did you hand over the car? If it was a dealer, does he have a premises?

    He paid me cash I didn't buy a car straight away I can't remember the date at all it was last year anyway .. so i am screwed in other words am I ?

    If you can't tie it down to some rough estimate of the time, and you can't remember who you sold it to, I'd say you're going to have a bit of a hard time persuading the Gardaí you're being honest if anything does happen.

    I'm going to try figure out a date but as for a na me I've no clue but is the solicitor is gonna gave any trouble signing it if I just paid the toll today

    I wouldn't have paid the toll, but that's just me. I think the payment of the toll is going to be way down the list of reasons he might have for not signing off on it.

    Did you cancel your insurance on the car when you sold it. If so you could contact the insurance company and get a date when it was done.

    And do I have to tell the solicitor that I paid the toll ? Can he refuse to sign the papers if he can what reasons may it be thanks guys

    The Peace Commissioner (solicitor) only signs the declaration as a witness to your declaration.

    How did you advertise the car for sale, would there be any record of the ad on-line?
    Having roughly worked out sale date, could you go back over phone call / text messages and try to work out the buyers phone number.

    As one poster said find out what date you changed your insurance policy . Surely you have a text or email or something from the dealer? Did you get a receipt or anything ? Dealers usually don't sign the log book .

    I wouldn't bother with solicitor just go declare it as not being yours anymore and say you posted it to Shannon and it's not your fault if it didn't get there.
