question about how important correct details are in court

    if hypothetically the gardai were to put in a court report that an incident had happened in Street B, when they had been told by everyone who witnessed the incident that it had happened in the adjoining street A .. could this be cause for a case to be struck out due to a technicality ???

    If the case rested on the event happening in that particular street, yes it could. For example, if there was a different speed limit in Bridge St. and Main St., getting the street wrong on a summons for speeding could be fatal to the Garde case.

    On the other hand, if it was an assault or theft and someone points out that the event happened in a different street than the one mentioned on the summons, the judge can simply change it there and then and proceed to hear the case.
