Stopped at a checkpoint (No insurance)

    Hi guys,

    Before anyone jumps at the title of no insurance, please read.

    Here is a long one. I have been having issues with my insurance brooker for the last 5 months. They were happy to insure me and take the full price of the insurance on the day I got it but then cracks appeared.

    I sent in documents as required (NCT, NCB, Logbook , licence proof) and didn't hear word back from them for over a month nor did any disk arrive in the post. I rang up one day and found out that no documents had been received. Shortly afterwards I received an email saying documents will need to be sent in or policy might face cancellation.

    I got the documents again (took a while to get ncb) and sent all back in. Looking back I should of sent by tracked but I had just placed it in a postbox close to my home and considered all sorted.

    I emailed the company four days later to confirm all was received and they said nothing arrived. The same day a tracked letter arrived from the insurance company (not brooker). saying my insurance has been cancelled from this date and all documents relating to it (disk) should be sent back.I was also told a refund would be issued. By this point i was getting frustrated and rang the insurance company directly but they wouldn't deal with me and instructed me to ring the broker. I done so and agreed I'd digitally sign all documents and send them. All was sent bar NCB and broker said "All looks fine now,just need your NCB as soon as possible) which I requested again from my previous insurer.

    About two weeks after this conversation, I was stopped at a checkpoint. Asked about no disk in the window, stated I'm insured just haven't received disk.Told to produce within 10 days.
    Rang insurance broker and was told policy was cancelled.

    Tried to argue my case but no joy. No insurance. I then asked about my refund. According to them its being processed and will be out soon.
    After three more calls to insurance broker and realizing

    1) No refund processed yet
    2) Guy who I was speaking to left the company
    3) New phone provider so call recordings an issue


    I asked for a callback from a supervisor/manager and was told I'm not obliged to do that. I contacted the company over the broker and they were very apologetic and issued a cheque within one day. Now the documents that I received with the cheque contradict my emails to the broker and the law.

    One letter addressed to the broker said

    "Under your instruction,we have cancelled this policy"

    The employee who I dealt with stated in email that the insurance company cancelled the policy. On the bottom of that letter it also stated

    "Under the customer data act.All insurance rebates must be received within 5 working days"

    Mine wasn't received until a month after the date of that letter.

    So my question is, what am I legally entitled to do. When I get the summons for no insurance,does it mean I'll be prosecuted even though I was under the impression I was fully legal on the roads

    I still haven't cashed the cheque as I never wanted my policy cancelled in first place. Will the broker be in trouble for not issuing a refund within 5 days under irish law

    Sounds like an ordeal all right.

    But once you have proof (with dates) of all documentation, the next step could be Small Claims

    I'd imagine the best thing to do here is get all your docs together and get everything the broker and insurance companies have under a data access request (think it costs about €6.50) and get ready to plead your case in court. Then, as the poster above says, small claims court to recoup any money you're out as a result of it all.
