Who pays to widen the road?

    We are selling our house and the verge was never cut back by the 5m called for in the planning. It is a solid rock bank that comes to the side of the road.
    This was 18 years ago and it is statute barred which means that we now don't have to. However the prospective buyer has been told that if the council wants to widen the road in the future the owner will have to pay for the widening of that section.
    The house is in Donegal.
    Is this true?

    I would check the exact wording - "cut back a verge" doesn't sound like the wording they use.

    The owner will also need to comply with the existing planning permission if they want to apply for a new PP.

    I think the official term is set back. However, that is now not enforceable as so long has passed without it being enforced.
    The question is if the council want to widen a road that a property butts onto, who pays for the widening of that section.

    The home owner pays.
    The condition is non enforceable but it still makes the site be non compliant and any buyer will not be able to mortgage the property.
