Ebay returns question

    Hi Guys.

    I sold a Iphone 5 SE on ebay 25 Apr

    The buyer received the phone on the May 3rd but today has requested a return because supposedly he cant unlock it.

    I said in my ebay ad

    "Selling a brand new un-opened Apple iPhone 5 SE 16GB Black. Still in the plastic wrapping

    It's locked to three Ireland but I presume this can be easily unlocked by a phone shop.

    No problems posting to the UK as well"

    The seller won't accept returns for this item.

    Im pretty sure im covered? Never had to deal with someone wanting a return

    Id be very surprised if you cant unlock an Iphone 5 SE.

    Not an iOS user but from assisting family there are two network locks for iPhone:
    -Type A: Unlockable with 16 digit code
    -Tybe B: Unlockable via iTunes only when the original operator has requested it

    From dealing with a Three 5C recently they use the latter, so only Three can unlock it.


    If it was an upgrade from Three you can request they unlock it and then the buyer can just connect it to his/her PC. If it was bought PAYG and you never used it then you wont have hit E130 of credit spend to be unlock eligible.


    Ebay/Paypal tend to be very buyer biased so be careful.

    As ED E said it will be lock with option 2, so 3Ireland will need to request the unlock from apple.

    You could suggest the buyer to check online shops as some do unlock them, also some sellers in Adverts.ie, looks like for €70 from Irish websites some UK shops are cheaper..

    If the phone is on your name you can request a free unlock directly from Three here.

    A 16 digit code for unlocking iPhones? Never heard of it. Only ever unlock via iTunes, AFAIK.

    Pretty sure those shops can only provide you a code which, from my limited research, is useless to you when it comes to Three IE iPhones.

    There is nowhere to even put in a code on iPhones. These shops work on accessing the operator database and faking the request to Apple. They seem to have limited, if any, access with Three. It has always been nigh impossible to get a Three iPhone unlocked, whereas it was easy for VF, O2.

    If I was putting money on it'd be with Paypal issuing him a full refund.

    I can't see how he'd have any chance of a refund. His only dispute options are "it didn't arrive", which you can prove it has, or "significantly not as described". For SNAD, the buyer has to show that the seller mislead in the sale. This was sold as being locked to Three, therefore not misleading. The buyer made a decision to buy a locked phone without checking out how to unlock it. The seller has a no returns policy too, which means he doesn't have to accept the return.

    Paypal do side with the buyer in a lot of cases, but I can't see how he would get them to refund for this. I've been in situations where the seller issued a fake tracking number, and Paypal closed my dispute due to "proof" of delivery - with a fake tracking number.

    On the other hand, the seller could decide to offer a partial refund for returning the phone. Maybe offer 80% of the value back due to the costs of posting the phone out in the first place and the hassle of having now to get it re-sold.

    "I presume easily unlockable" vs I have to unlock it for you and I haven't done that would constitute SNAD IME. Caveat emptor to some extent for the buyer but there are easily unlockable units out there so its a plausible but incorrect description.

    Very little you can do.. ebay will almost always side with a buyer even if they are thick
