Have hit a blind spot on this, so just to be sure....

My NCT disc has just expired.

But, my tax isn't due until August, and insurance not until September.

Must I have the car NCT'd now, or can I wait?

    Thanks.

    D.

There is no point in delaying NCT, a new cert will expire a year or two from the previous expiration date.

However, it can wait. You need tax and insurance to drive to Nct centre. You need insurance to tax the car.

No, it is not... You can even, under some circumstances, drive a car without NCT.

    You read my mind.

Yes, I thought I could delay it and bring it into line with insurance and/or tax.

    Evidently not.

    Thanks.

If you NCT it in 4 months time you gain nothing anyway. The cert is issued for 1 or 2 year(s) for when it was due. You don't gain any months. It's also a fine and penalty points if caught. Not worth it. If car is in good roadworthy condition, you are as well to just get it tested. Not all insurance companies will ask for tax or nct certs. In fact, I've never been asked and I usually switch insurance companies every year.

If caught driving without is it not now €80 and 2 points?

If you can prove you're driving to or from the test centre you aren't breaking the law ( a direct copy of the "no mot" law in the UK)

    That's incorrect.
It's illegal to drive without NCT, even to the test centre for the prebooked test.

A car can be taxed without it being insured.

Make yourself acquainted with note C3 on RF100a. Sure - technically you can tax a car without insurance - just provide a number and expiration date from thin air. But you'd be willingly providing false information, might come back to bite you...

Yes it is. There's an exemption for cars from non connected Islands but that is it. You can drive back if you fail though!

That is my understanding as well.

However there is a small ambiguity about that and Gardai do typically reverse the penalty if you fail NCT on the same day.

If caught with no nct there's a fine and points. And I know every policy is different but mine specifically States that a claim well not be paid out in the absence of a valid nct.

If only there was an invention of a paper disc you put on your windscreen that showed the date when the NCT expired and you would see this date each time you passed by it as a reminder of when it was due, you could then add in the facility to book the test 3 months before it's due, I think if these simple ideas were brought in nobody would have an excuse to be driving a car with expired NCT :pac:

Exactly. My Nct is out in mid October, my tax is out at the end of September insurance isn't out until may 2018, I didn't even have to leave the house to check..

While as usual they ignore the more serious offence of driving while not insured, the majority of insurance policies require a valid NCT which doesn't allow you drive before or after you fail.

The stupid thing is that if you drive a safe vehicle with no NCT to the NCT there's no ambiguity you've committed an offence, if it turns out to be defective you might not have.

Surprising the number of people who don't notice it run out.

Is it legal then to drive home from test with a fail sheet ?

Also is there any Garda discretion on the way to a test?

Not illegal to drive home after a fail, but you most likely aren't insured. If you pass the is no discretion yet if you fail its not clear if it nullifies the offence when going, but again the lack of insurance is ignored in all cases.

If you're caught with no NCT, it's 3 points and €60 fine.
5 points and €90 if convicted in court.

If your vehicle fails because it has a dangerous defect, and you get caught, it's a mandatory court appearance, 3 points, and a court fine.

What happens if you go in 90 days before due due date and you fail.

Does it depend on what it fails on whether yours insured to keep driving ?

The existing NCT continues to be valid until it's expiry date.

What if you had a crash and it was shown the car was not roadworthy according to the fail sheet ,even though NCT cert is still valid for another 90 days.

I can see insurance not paying out

You would still have a valid NCT tho which would be in line with the insurance companies T&Cs. However they prob also have one about it being in a roadworthy condition as well so who knows.

If they can prove that it was owners lack of action that caused the accident, their liability ends very fast, NCTed or not.
