    HI
this poor little fella is in my garden, chirping away for help..
trying to fly but can get about 10 cm in height.. he is not afraid of me.

dont want to leave him the night outside on his own.

Baby robin or wren (plenty here will know for sure), probably a brood of them in the vicinity. The parents will be doing the rounds feeding them so they need to be left alone.

Robin. Put it back immediately. It is fine.

I wish people would leave young birds where they are at this time of year. 99% are absolutely ok as they are.

It's not sad though. It's just waiting it's turn for food from the parents.

We just found a similar bird, parents tell me its a baby blackbird (prob correct as its visually somewhat similar to the photo above but larger). Garden is home to 2 cats (and the other side of the inclousure 2 dogs) so no idea how it actually got there, definitely didn't hatch here. To save it being imminently mauled we moved it to safety.. but now what?

Can we release it in the nearby woods (ie across the road)?

It really needs to be put back within 10m of where it was found, if the parents are to find it. There has to be a bush, hedge or tree you can put it in
