Does the clamper have any actual powers these days ?

    I keep seeing clamps cut off in my neighbourhood by the same people over and over again. Now the law apparently changed a few years ago but its made no difference that I can see.

    Do they ever pay up or end up in court ? Or does NCPS not bother to do anything ?

    Furthermore I've noticed a new thing (on cars in UCD for example) - a ''fixed charge'' ticket on the windscreen but no clamp . Do they have any legal recourse to collect this charge in the same way for example that a private tolling company has if you dont pay the toll ?

    None will ever go to court where the clamping occured in a private contracted area, if they did it would open the floodgates for people to all just cut them. Currently someone could charge 1 cent or €6.5 million to remove the clamp, there's no limits. In addition unlike the security sector there's no background check on anyone setting up a clamping business as to whether they are fit to run such a business where your car is held ransom.

    Vehicle clamping

    ...........The Vehicle Clamping Act 2015 provides for the regulation of clamping but has not yet been commenced.


    Clamping law having no impact on fees
    the Vehicle Clamping Act was enacted in May 2015. The Act conferred the responsibilities of regulating vehicle clamping upon the National Transport Authority (NTA). This conferral of additional responsibilities resulted in a requirement for allocation of additional resources to the NTA in order to allow it carry out its new functions in this area. Sanction for these additional resources was secured for the NTA's budget for 2016.
    In addition the NTA also required a period to make and prepare the necessary regulations provided for under the Act as well as ensure appropriate training and administrative supports are in place to allow for commencement of regulatory activities.
    This very necessary preparatory work is almost complete and my Department is now finalising arrangements with the NTA in relation to an appropriate commencement date.

    FYI, if you move to a 'smart' meter electricity plan, you CAN'T move back to a non-smart plan.

    You don't have to take a 'smart' meter if you don't want one, opt-out is available.

    Buy drinks in 3L or bigger plastic bottles or glass bottles or cartons to avoid the DRS fee.

    With regards to UCD, once students twigged that the clamping being carried out was a grey area, clamps started being removed.

    So they added a fixed charge ticket. In theory, you'd think it's unenforceable. However you're not allowed graduate with any outstanding loans or fines so on the student population it's easily enforced.

    The only campers that currently have authority is those operated on behalf of the council. So clamping by Dublin Street Parking. Cutting one of them off could land you in serious trouble.
