Randomly selected for review due to incapacitated child tax credit

    Hi,

    Can any shed light on this with past experience?

    My fiances son has being diagnosed with a long term illness and as such she has been advised she is entitled to incapacitated child tax credit.

    She applied online in feb and was advised that she needs to send in p60 for the previous year of 2016 and the doctors confirmation etc of the illness.

    She did all this and received p21s for the last 4 years and the tax credit was applied for 2013 but not the next 3 years. She has been on numerous times and has been told it take 6 weeks to be resolved as it has to manually applied but in addition has received conflicting information that the credit will be applied since the child was born which was 7 years ago or that it will only apply from the date she applied. She waited the 6 weeks and has contacted again and has now been told she is due a credit for last year for usc etc but this is being withheld based on a "random review" for the incapacitated child tax credit.

    This is bizarre as the credit has been applied on the p21 for 2013 but has not for the next 3, she is due a refund from 2016 for usc but this is being withheld due to the random review. The lady was unable to advise when this will be resolved as it has to be signed off, however she did say it's usually 4 weeks after the info was submitted which was 6 weeks ago.

    Any advice is appreciated

    Repayments are often held at random, and the caseworker may look for additional information in relation to a specific part of the claim, this is called an aspect query.

    It may depend on the kind of illness stated on the form. For instance, Diabetes is a long term illness, but is not a qualifying illness for the Incapacitated Child Credit - even if a doctor ticks the box.

    ADHD is not something that qualifies in itself, although Autism related illnesses may, depending on severity.

    Although others have been approved, theirs have not been selected at random for checking. These will have either been awarded incorrectly (if the credit is in fact, not due), or will have somewhat slipped through the net.

    Although it has been applied for one year already, the credit itself is now being examined, it seems. If it's found to be not due (and they will have to tell you why it doesn't qualify), then they can always claw back the relief already given.

    be aware that the single person child carer credit came into existence in 2014 replacing an older credit with less stringent rules.

    thus may be why she has the credit in 2013 but 2014 is subject to a review.

    Hi thanks for you reply, it's called the incapacitated child tax credit, was this called single person child carer credit? She's not single and we told this credit can be applied regardless of relationship status

    Sorry bad day for me. I was thinking of single parent tax credit which is now single person child carer credit but before 2014 was called something else and both separated parents could claim.

    My apologies.

    Anyway for the incapacitated child carer credit only one parent can claim it or it will be split in proportion to the amount of maintenance paid in relation to he child.

    Is there a chance your finances ex oh has claims in for 2014-2016 so revenue will grant for 2013 but not for subsequent years.

    I sincerely doubt it as the child has only been diagnosed this year and he wouldn't be aware of it, plus he would need doctors forms etc for the claim and we are 100% he has not done that.

    It's a strange situation that hopefully is resolved
