Private Right of Way.. extinguishment

    Hi. Want some advice . I will ask a Solicitor also!.
    My parents have a house in a corner site in a rural town. About 20-30 years ago, my father granted a private Right of way to his sister in case she needed to access her field behind our house. I see it highlighted in maps of his lands that he has. I don't doubt that it was agreed at the time. Well, fast forward to now, the right of way was never used once ( as there is another entrance to that field now). In fact the right of way is basically the sidelawn of our house and at the end is a stone wall i.e. There isn't even an entrance into the field.. so now we may want to extend the house into this sidelawn. Does the land act 2009 mean that if it has not been used for over 12 years that it's pretty much gone?. Also, my aunt doesn't own the field behind any more and the current owners probably don't know that this ROW exists.

    was the right of way granted to his sister or to the owner of the land in perpetuity?
