A quesion about Customs Charges.

    Not sure if this is the right place or if its been asked by beforebut here goes .......
    I bought some goods in the EU zone so assuming all liable charges paid here.
    I subsequently sent the now used goods to the US for repair. The company I sent the goods to ONLY deal with repairing used items.
    The repair was completed and sent back but was stopped by customs and charged.
    I paid the charges but then appealed the decision stating the above ie the goods were used leaving here ,repaired and returned.
    I subsequently got a reply from customs staing "The used goods that were sent from Ireland to the US for repair then returned are liable for Customs charges."
    Is this correct?
    Can used goods returning be subject to customs therefore effectively paying customs a second time*?


    *Working on the assumption that tax was paid the first time as they were bought in the EU.

    Seems odd.

    Can you prove where they were bought and have proof of sending for repair.

    I don't believe there should be any charge as its a repair.

    Worth looking into.

    I linked them the website of the company that I sent the goods to and a screenshot of the email enquiry about sending the stuff over.

    .....and sorry Yes I can prove that they were bought in the EU as they were purchased on eBay.co.uk form a UK seller in the UK!

    I would put all your proof together and send off to the department that charged you.

    The only thing I havent sent them was a screenshot of the ebay sale.
    But form the email I recieved back they have accepted the goods were used leaving here for repair......"The used goods that were sent from Ireland to the US for repair then returned are liable for Customs charges"....a direct copy and paste form the email.
    This is wrong ,surely?

    Here is the full email.I have deleted the price as its not about the price but the principal.

    "The used goods that were sent from Ireland to the US for repair then returned are liable for Customs charges. As the goods were declared as xx.xx usd the customs charges were calculated on this figure. "

    Good morning.

    A couple of things to bear in mind.

    1. If the goods were repaired under warranty then you should not have to pay VAT or Duty on return.
    2. If you paid for the repair than you only need to pay VAT and Duty over the cost of the repair and the transport to/from the place of repair.

    Normally you would make a declaration on export to the effect that the goods are being exported for repair. On return you would submit that to customs and customs would apply either scenario 1 or scenario 2.

    In the absence of an export declaration you would nees to submit proof of purchase and advise to customs if the goods were repaired under warranty or if you paid for the repair. Also submit any correspondence that supports your case such as receipt, credit card statement etc.
