(Dead ) Right of Way

    My home is in a row of houses . There is a drive trough from the main road to the back of the property. I have to pass 4 houses to get to my place.
    This right of way is not written in on the deeds but is used several times a day and have been for decades.My solicitor informed me that I need the agreement of the owner's of the houses I pass to be able to sell my property.This have been done exept for one house .
    The position is that one of the house's is still in a deceased persons name there was no will made and the family member looking after it is willing to sign but this will not do according to law.
    Do I need to apply for a right of way to the authorities? Or what should I do?
