Missed garda payment

    i received a notice for speeding and missed the 56 day window for payment. i sent in the form and it came back saying i was too late. in the end i was about 2 weeks late. unfortunately the next step is a day in court.

    i genuinely forgot the charge and as soon as i spotted it i tried to rectify it straight away. is there anyway of settling it without resorting to a court date?
    and if there isnt what can i expect in court

    Similar thing happened to me , went to court and was fined 100 euros

    Just 100 euro fine in total , judge was kind . Another day a different judge and the result could have been different

    It was a guards that caught me speeding and not a speeding van so that have might of made a difference with getting no penalty pts

    Get proof of attempted payment at post office.

    Bring this to court.

    Plead not guilty. And submit proof of attempted payment.

    And basically beg the judge for mercy.

    I spent the day in Naas court last week. Judge must of had a bad morning, no fine he gave out was less that €200.

    I'm not sure about that approach...most Judges don't take well to making excuses

    Did the gov not introduce some procedure recently where you could pay twice the fine and only take 3 points instead of the 5 that go with a court conviction once the summons arrives and before the court date, in order to deal with the people who say they never got the fixed penalty notice.

    Many drivers have been able to avoid prosecution by claiming in court that they never received the penalty points notice.

    As fixed-term notices are sent by regular post and are not registered, it can be difficult to prove whether the driver has received their penalty points or not.

    This third payment option would aim to rectify this by, it is believed, arriving along with the summons. Motorists will have the option of paying the increased fine or going to court where they cannot use the excuse that they had not received the fine. It is already provided for under section 44 of the Road Traffic Act 2010, but has yet to be commenced.

    If you plead guilty.. that's the matter finalised.

    You won't have an opportunity to explain your case.

    So, plead not guilty, and give your reasons, but if court is an alien experience, get a solicitor.
