Outstanding claim

    My spouse has an outstanding motor insurance claim against her. The accident happened 7 years ago and still hasn't been settled. As a consequence she can only take insurance with the same company she had at the time of the claim. The premium she is being charged is €1,800 per year more expensive than the competitors for the same cover, only she cant move because of the outstanding claim. It appears that there is no real incentive for her insurer to settle as they aren't paying out to the claimant as well as hiking her premium. Surely this cant be right. Anyone any advice here?

    I'm assuming that if the claim is running that long that its either a severe and complex injury claim or that your insurer feels that it is worth defending it as they think its dodgy, possibly a combination of both.

    There is little she can do I'm afraid.

    I can understand your frustration and I'm genuinely surprised its taking that lenght of time to settle, she wasn't one of the unfortunate people that was with Setanta at the time of the accident by any chance?

    Anyway, she is pretty much stuck until its settled unfortunately. When was the last update received from the insurer?

    No its not Setanta. Last update was yesterday and there has been no progress in the last year.

    Ye are pretty much snookered so I'm afraid.

    Xcess direct are back operating in the Irish market, they offer a basic policy with a €3k excess but they have cheap premiums and specialise in drivers that can't get quotes elsewhere.

    Could be an option.

    im in the same boat, crashed last november but only finding out now that the third party has a potential personal injury claim against me(:eek:).

    We're 7 years down the road from the accident and getting flogged every year on renewals. Her insurer is charging €1800 MORE than competitors. She declares the accident when getting quotes however when they find out its not settled they don't want to know. We're truly screwed - it does seem right at all.....

    I cant even get a quote from my current insurer because i went through a broker

    Have the insurance company said why it hadn't been settled?
    I'd be looking for more details from them, is it in court etc.

    I'd be inclined to get in touch with the ombudsman, surely there must be some obligation to process claims in a reasonable timeframe.

    All offers by the insurer to the claimant have been refused. The process is compounded by the fact that the claimant has moved abroad.
