Dentist negligence claim

    Need a suggest about dentist mistake issue.
    In October 2016 I broke my tooth (small piece).
    I went to my dentist and she said I need a filling. It was small (not deep) filling.
    I have got it!
    Yesterday (09 March 2017) I went to another dentist (about wisdom tooth) and she suggested me to make a big x-ray of my teeth to be sure what is wrong with my wisdom tooth. After the x-ray she noted something is wrong with the tooth with that filling. The tooth decay under the filling and I have an infection there.
    The new dentist suggested me RCT, it is very expensive procedure...
    So if that filling is new, but tooth decay under the filling, I think it could be my first dentist mistake? The air comes under the filling.
    Another problem - two months ago my first dentist removed my tooth (another tooth) but remained a piece in the gum. New doctor notes that there is a piece of tooth's root inside.

    I will have a consultation with a solicitor next Wednesday.
    Who have ideas about this issues? Can I claim compensation from my first dentist?

    Did the first dentist take an x ray of the tooth before he filled it?
    You could compare both the new and old x ray and see if its recurrent decay?
    Sometimes with a filling for a number of reasons you can get decay occurring around it.

    Did your first dentist inform you that there was a root left behind? Was it a difficult extraction?

    I have left root fragments behind and informed the patient that as the socket heals that the fragment will be pushed up to the surface. It is easier to remove when it reaches the surface than to surgically remove it on day of extraction (involves cutting gum, removing bone to reach root, this makes placing an implant later more difficult). Most patients are happy enough to leave it and remove later when it is easier to get at.

    From your post I detect you are not Irish. But that did'nt stop you from acquiring the Irish tradition of thinking litigation at the drop of a hat:eek:.

    Would you not discuss your issue with your first dentist? She may be willing to work on an amicable basis to help you. Going down the litigation route is a lottery, and what if you get a solr that is gung-ho for a court case, and then loses? Will you be back here with that issue then?
