Cert of Compliance

    We are in the early stages of trying to sell my parents house. The estate agent has raised a small query with regard to velux windos in 2 bedrooms. The house was built in 1992 and my parents bought it in 1998.
    Would they have needed the cert of compliance to buy the house.
    If so and the solicitor does not have a copy, what are our options.

    Where are the velux windows?

    If to the front then planning is required.
    Options - remove them or apply for retention (3 months).

    If to the rear then they are exempt.
    Options - print off the legislation covering it or pay an architect for a certificate of exemption (approx €3-400).

    Cheers, they are to the rear, the solicitors were able to mail me on a copy of compliance for the build but there was no mention of the windows. Do I need to match this off against the plans. If the windows where in the plans then we are ok?


    The veluxs are about 170cm off the ground.

    ignorance and google are dangerous things and combined they can they terrible.

    Had a quick look at the regs from 1990.
    Please tell me if I'm wrong, work is exempt from these regs if started before 1st June 1992.
    The house was completed and signed off in July '92.

    Would I be correct in thinking that the house is exempt from these regs.
    Am i best to get an engineer in to confirm this in writing,

    I think you are mixing up two different compliances:

    Compliance with the Planning Regulations
    Compliance with the Building Regulations

    If the purchaser is doing things correctly they will be looking for an "Opinion on Compliance with the Building Regulations" and also an "Opinion on Compliance with Planning Regulations."

    The 92 date and the 1.7m you mention are related to the building regulations. The front/back issue is related to planning.

    Also the height above floor level for velux windows is specifically related to their use as an escape window for fire safety (Part B of the Technical Guidance Documents that accompany the Building Regulations).

    I think you need to get a professional to guide you through what exactly you need and don't. You also need clarification from the solicitor as to what exactly is being sought.

    It will cost you a few hundred euro in professional fees if you engage one now - or many hours of your own time, a lot of stress and THEN a few hundred euro when you realise you need to engage a professional then!
