Accident : Car Towed Question

    My Car was hit by a motorist who failed to yield before driving onto the main road I was travelling on. Once the gardai arrived I moved my car off the main road and into a housing estate where I legally parked and away from any house.

    Whilst I was being checked in the back of an ambulance the Garda apparently phoned a local tow Company. I did see the tow truck arrive but I got a lift home before my car was attached to the tow truck. The Tow Truck driver nor the Garda asked me if I wanted the car towed.

    After I got home I phoned the insurance company and they told me to get my car out of the tow company storage asap as it is accrueing storage charges and I'd be liable for the storage and towing.

    Where do I legally stand here? The accident happened within walking distance of my home and I would have got the car dropped here and made my own towing arrangements.

    I phoned Tow Company who are firmly sticking to the line that if I do not pay car will not be released for repair or scrap etc.

    Retrieve car, argue later might seem prudent.

    How bad damage was on car because if bad enough and left on road even parked up could have been a safety issue and also attract unwanted attention.

    Ask them to release pay towing charge but try work on price(haggle)

    If car is to be repaired get it out to where you want it fixed. Other drivers insurance will eventually have to cover your expenses and loss once blame is on their side.

    Is it driving? If yes go collect and get where you need it to be.

    BTW - The other Vehicle was a Company Service and was not towed despite similar damage and parked right beside mine

    You will get towing fee back off other parties insurance so don't be worrying but if you don't get it moved they will contest storage.

    Pick a garage you want it repaired at if you are doing so or if scrap get it towed to scrap yard or if not sure get brought to your house.

    I've been there and car was towed two separate occasions at different collisions.

    Keep all receipts and just tell other party insurance it had to be towed nothing else needed.

    I've been there hopefully your OK.

    These things happen part of driving and life.

    Any issues or any other issues and need help don't hesitate to ask.

    Get it out asap cause some charge quite a lot on storage and they can hold until paid.
    I understand you didn't ask but one thing I know you won't win with them or cops.

    Not worth the stress either and believe me its not been soft or whatever but just to be sorted and back on the road.

    Keep in contact with insurance and see how things will be rectified.
