Employer not paying minimum wage

    Min wage went up to 9.25 at the start of the year, i've a friend working in a shop, he's only noticed it went up but employer never paid him the increase.

    I had a google there and to complain you first have to write to the employer about the alleged discriminatory act.

    If he did that he'd get the door, if he says it to him, he'd get the door.

    Tell him to be smart and say nothing. Having a job and a weekly wage is more important than opening your mouth, getting the sack and going on the dole.

    Let's be honest here, he wouldn't be the first person to be shown the door after opening their mouth and he wouldn't be the last either. While another person would gladly slip into the job and not care about the actual min-wage.

    Dont be giving rubbish advice like that until we've at least found out if he's outside probation.

    Could be a very clear cut and dry increase or unfair dismissal.

    Or you could clearly read what the op said about him mentioning it and getting the door. Aka, it's that type of place.

As it happens employment is back to pre-2008 levels of about 94%.The only people unemployed are those who dont want to be and the unemployable. Your mate says it to his employer and gets shown the door and gets another job sharpish. Meanwhile the ex employer has a tough time finding someone to replace your mate because he refuses to pay minimum wage.

    I dont hold with this "youre lucky to have a job" mentality. Not when theres lots of jobs out there anyway.

    Then why don't you offer your own advice ;)

    Join in on the discussion. Fact is you don't have to agree with what I said nor I do yours. But add to the advice rather than slating another's.

    What crap?? Just back from 2 week holiday in South Africa and I can assure you 9 euro an hour would pay a mortgage over there.

    He's near 2 years there, i'd read the citizens info page, 2 years work after 18th birthday to be classed as qualified adult, he is that.

    I was asking him about the last min wage increase and employer waited 4/5 months before he bothered to give the increase but never back dated it. Real scumbag multi millionaire this guy.

    What can he do?

    This sorta thing should be more easily reported.

    What does he do?

    First of all, your friend isn't making a complaint yet so don't start off by writing formal letters and quoting from the WRC or it'll really get his bosses defenses up. Have an informal chat, remind him that the minimum wage has increased and ask for it to be applied going forward. If he refuses then you can write the letter. After that if your friend gets the boot - 1. It's not a place he should want to work anyway, and 2. He can claim for unfair dismissal.

    Don't take the advice of staying quiet and being taken advantage of just for the sake of a job. That's the type of advice that allows scumbag employers to get away with it.

    Does he get a payslip showing hours worked and pay rate?

    if so keep the paperwork, find a new job, then stick in a claim for backdated wages.
