How can I force car dealer to transfer ownership

Bought a car from a dealer. They are trading and all looks ok but it's been 4 weeks since I bought the car and I've been given the run around regarding change of ownership

Motor tax office said you can not do a statutory declaration because they don't apply to motor dealers

Car is in the dealers name! I'm really stuck as what I can do now. Garda's said it's a civil matter

Anyone come across this before and how to solve?

    Thanks in advance

Drive it through the M50 toll a few times a week.

Call Shannon in the morning for advice on the Stat Declaration.

Keep showing up at the premises and ask for them to give you the paperwork in front of other customers.

It took approx 4-5 weeks for my car to be changed into my name bought early January in fairness.

Just to add. If it's a main dealer they will have access to the National vehicle database and can do it in house in most cases.
If its second hand, they may not have the log book and an RF134 will be needed to get a duplicate.
Which MTO are you dealing with. Some are more helpful than others.

I had same problem with a dealer on Sundrive road Eventually had to fill in a form supplied by Shannon tax office and go to main dealer and have engine number noted and stamped € 20 then declaration at local peace commissioners with donation 2 days after i posted it off the dealer forwarded it on

    Many thanks

I've rang Shannon and they said they can't help.
Replacement certification applied for and its "gone" missing too
Sat in there office today and last week.
Given them the benifit of the dout for weeks now.
Shannon are processing vehicle changes in 3 days!

Only thing I haven't done is do the form Mikethediyman had to do. I was told I couldn't
By the local tax office But it looks like I can, so thanks a million.

This car dealer isn't a main dealer btw
It's a stand alone dealer with very poor admin or customer services skills

My dealer was not a main dealer either so I had to look for one and ask them to certify the number stamped on engine - hence the € 20 charge

Perfect. I'll get that sorted tomorrow. The funny thing is the main dealer is across the road from were I bought it. Won't look good for them at all

Mikethediyman, was your car in the dealers name when you had to force the sale? or in the previous owners name?

If you do a vehicle transaction query on motortax.ie it will tell you if it was transferred into a dealers name in the last 3 months. They'd have needed the reg cert to do this. my guess is they never had paperwork.

I bought a new van on 7th January. It took 5 weeks for the log book to arrive. Maybe the garage isn't dragging it's feet

Reg Cert was with the auction house that dealer bought it from, and for some unknown reason two Certs have gone missing! That's were it doesn't add up. My local Garda told me today to get a parking fine on the car!

The car was in the dealer's name This is one thing I have a gripe about my car has 8 previous owners but most of them are car dealers Not happy the motor tax people include them as previous owners as they are only keepers while awaiting a sale

Dealers with a TAN do not show up as previous owners on the logbook.

Mike was talking about a statutory declaration. If Shannon have said you can't do it, then you can't.
Garage should be able to apply for a replacement VRC using an RF134.
Unfortunately they do go missing in the post or lost if the address is incorrect. The amount of times I've seen dealers write the wrong address is scary.
Bring a 134 to the dealer and get them to fill it in. It will cost 12€ but at least you can go get it stamped and send it to your local MTO. A new vrc will go to the dealer who can then give it to you to get transferred over yourself

I've done all this Duke Miniature Peanut. Got it filled in and paid the €12 to the tax office and they sent the replacement last Monday.
It's not turned up as of today. I went in person to the motor tax office and they said sorry but nothing they can do.

I'm unsure as to why a motor dealer can't be held accountable for not having paper work sorted. Tax office said this dealer does it regular

I know mine has not been sent in as the dealer never had the Cert to start with
You should have your Cert within 10days if the dealer does everything by the book

    Was the address correct?
What address was in the form? The dealer or the previous owner?

You should be able to confirm the address with the MTO once you can provide it. Which MTO did you deal with.

Address correct, it has to be signed by a guard so all checks were 100%.
Sent to garage address linked to there garage code.
All was done correct. Tax office was limerick. They were unsure what they were doing behind the counter! Shannon confirmed were the duplicate went! Which was the garage

You need to be a thorn in the side of the garage. You need to be such a pain in the ass for them that they will sort it out to get rid of you. Park the car close to their premises (no illegally as it might be removed) with a big sign in the window saying that you bought it from them and still waiting on them to transfer of ownership. Let potential customers see that as they enter their premises. Go down there every day and in front of customers in their showroom ask them in a voice that can be heard by other customers in the there (don't shout) when they are going to sort it out.

    Well, yes....

What a Bizarre country we live in. I'm sure if something happened like a serious incident involving the vehicles including possibly armed robbery then who would be liable? Presumably the name that appears on the VLC.

I have been trust me. The whole tax office was told why I was there.
I'm going to sort it myself tomorrow to force the sale
Guards told me get some tickets on it as a parting gift!

you should whistleblow them if it's the Gardai you are referring to.

I don't think so! Everyone has been saying to me to get a few speeding tickets on the car and they won't be long getting it sorted.

I'd go with parking tickets over speeding tickets which are accompanied by points.

Yeah, I'd go down the parking fines route and run back and forth on the m50 for as many times as is possible.

To be honest it sounds like you're dealing with a dodgy dealer and I'd be worried if I were you.

I've had the garda's check the car out. They don't understand why the dealer is dragging there feet over it. Oh yes dodgey, not much on the internet about them but from just sitting in there office
    Things aren't right.

Garda said I've a receipt, a clear car and that I will eventually get my VRC so not to worry.
So I'm not for now I'm just looking for alternative ways to getting it in my name

    Fly38,
did you get it sorted? How long did it take?
I am in a similar situation, 2 weeks since I bought the car. The problem is, the dealer is in Dublin and I am in Co Galway. So I keep pushing through phone and e-mail.
I wonder, would it be against rules here (boards.ie) to publish name of these dealers (or link) to warn other people?
I would open my own thread, of coarse.

2 weeks is not that long again it goes to the tax office and back to you.

Mine took 3 weeks but I did ring the garage and they sent me a form to bring to the tax office and tax the car and then on Friday I received the logbook

These guys said me they would register the change of ownership on line - no paperwork. It means, based on info I got from motortax, the change would have been visible there immediately via motortax web page. Next day motortax would ship my certificate. THERE IS NO CHANGE IN THE OWNERSHIP LAST 3 MONTHS, THERE. So, these guys did not record anything, yet.

Oh well, it's been a while since I worked in the motor trade, when I did you couldn't transfer ownership online.

My brother had a few issues earlier in the year and was able to ring Shannon to verify if indeed the dealer had done the change of ownership.
Was handy as he could ring the dealer and call his bluff about having it bldone online a few days earlier.

    It was done that day.

Sometimes these guys are just inefficient or pure Lazy.
